Terms of Service

These Terms of Service (“Terms”) govern your access to and use of this website (“the Site”), operated by EX Solutions Inc. (“we”, “us”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Use of the Site

The Site is provided for informational purposes only. You may browse the Site and view content for personal, non-commercial use. Normal sharing of links to pages on the Site is allowed.

You agree not to misuse the Site or attempt to interfere with its normal operation.

Sharing, Quoting, and Linking

You're welcome to share links to the Site, and to quote or show screenshots of individual pages (for example a device's specifications, a benchmark score, a ranking position or a comparison) in posts, reviews, videos and articles, including commercial ones, as long as you credit DevCheck and, where you can, link to the page. You may also discuss and analyze what you see, for example by comparing or averaging a handful of scores in an article. This permission covers individual pages and ordinary commentary; it does not cover collecting or republishing the Site's data in bulk (see below).

Automated Access, Rate Limits, and Security

Normal use of the Site in a web browser is not affected by this section. To protect the Site and its data, we use technical measures such as rate limits, bot detection, traffic filtering, and abuse prevention (including services provided by Cloudflare and similar providers). You agree not to attempt to bypass, disable, or evade these measures.

Search engines and AI search and answer services may crawl and index the Site in accordance with our robots.txt, and apps may fetch a page to show a link preview. The restrictions in these Terms apply to all other automated access.

We may block, throttle, or restrict access to the Site (including by IP address, ASN, user agent, request pattern, geographic region, or other signals) at any time, with or without notice, if we suspect automated access, scraping, abuse, or unusual traffic.

Site Content, Data, and Restrictions

The Site's content, database compilations, organization, layouts, features, software and presentation are owned by or licensed to EX Solutions Inc., unless otherwise stated. Access to Site data does not grant any right to extract, reproduce, redistribute or commercially exploit the database except as permitted by these Terms. The Site and its data are not sold; access is provided subject to these Terms.

The following activities are explicitly prohibited without prior written permission:

• Scraping, crawling, harvesting, or extracting data from the Site, other than the indexing and link previews described above
• Bulk downloading, mirroring, archiving, or systematically collecting Site content or datasets
• Using automated tools, bots, scripts, headless browsers, or similar methods to access the Site, other than as described above
• Systematic querying intended to reconstruct or replicate the Site’s datasets
• Creating derivative databases, datasets, indexes, or competing services based on Site data
• Training, fine-tuning, evaluating, or operating machine learning / AI models using Site data or Site outputs (including API responses or exported results)
• Reselling, redistributing, sublicensing, or systematically republishing Site data or results derived from it (ordinary commentary and analysis permitted under Sharing, Quoting, and Linking is not affected)
• Displaying, embedding, or making available Site data on another website, app, service, or API, beyond the quoting and screenshots allowed above
• Removing, obscuring, or altering legal notices or technical controls intended to restrict automated access

Unauthorized use may result in access restrictions, permanent blocks, and legal action. We also reserve all rights to pursue remedies available under applicable law.

Commercial Use and Licensing

Apart from the quoting and screenshots described above, commercial use of the Site or its data (including integration into products, services, research pipelines, datasets, dashboards, or models) is not permitted without a separate written agreement. Commercial editorial use permitted under Sharing, Quoting, and Linking does not require a license. If you want dataset access, an API, a license, or commercial permission, contact us.

Accuracy and Availability

The Site displays data aggregated from reports sent by devices running the DevCheck app, together with public information such as device lists. While reasonable efforts are made to present useful information, the Site makes no guarantees regarding completeness, correctness, availability, or timeliness.

The Site may be modified, suspended, or discontinued at any time without notice.

Trademarks

Product names, chip names, logos and other trademarks shown on the Site belong to their respective owners. They are used only to identify devices and components, and their use does not imply any affiliation with or endorsement by those owners.

Privacy

Use of the Site is also subject to our Privacy Policy. Data sent by the DevCheck Android app is described separately in the App Privacy Policy.

Termination

We may suspend or terminate your access to the Site at any time, with or without notice, including if we believe you have violated these Terms or if your use creates risk or legal exposure for the Site.

Third-Party Services and Links

The Site may include third-party services (such as content delivery, security, analytics, or advertising) and may link to third-party websites. We do not control those third parties and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies.

Disclaimer

The Site is provided “as is” and “as available” without warranties of any kind, express or implied. Use of the Site is at your own risk.

We are not responsible for any decisions, actions, or damages resulting from use of the Site or reliance on its content.

Limitation of Liability

To the maximum extent permitted by law, EX Solutions Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Site.

Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of laws principles. Courts located in Ontario, Canada shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Site.

Changes to These Terms

These Terms may be updated from time to time. Continued use of the Site after changes constitutes acceptance of the updated Terms.
