Chris Milan reposted thisChris Milan reposted thisIf you are planning to use or purchase an AI tool in recruiting, your legal team isn't the problem. You just haven't given them a reason to say yes. I spent over twenty years in leadership roles watching TA teams get mad at legal for saying no to things. The frustrating part? Legal was right 70% of the time. Not because the idea was bad. But because the TA team showed up unprepared. Our very own Courtney Dutter, General Counsel at iCIMS, broke down exactly what this looks like in a recent iCIMS Fireside Chat. Legal teams manage risk. It's their job. And when you come to them with "We want to use AI in hiring" without any supporting evidence or vendor diligence, they see risk with no upside narrative. So they say no. But here's what actually happened. TA asked legal to take on risk without giving them a reason to. That's not legal's fault. That's TA's fault. The TA leaders who actually move AI initiatives forward do something different. They come to legal with three things. -One: Here's what we want to do and why. (Business case.) -Two: Here's what the ROI looks like if this works. (Time to hire down 30%, top-of-funnel expanded by 40%, whatever it is.) -Three: Here's the vendor, here's their responsible AI practice, here's how they protect data. (Homework done.) Legal doesn't become an obstacle then. They become a partner because you've given them something to work with. You've shown them you've thought about risk on the front end, not just hoped it would work out. Courtney gave some great advice to her fellow legal teams in the industry: "Get in the boat. Understand what they want to do. Figure out how to make it happen." That's what good in-house counsel does. But they can only do that if TA leadership meets them halfway. If your legal team is blocking AI, it's probably because you haven't done the work to make them comfortable and informed. Legal teams want to say yes. Chris Milan shared thisChris Milan shared thisI spent almost 5 years at iCIMS, implementing ATSs for some of their largest and most complex customers... in that time, I saw a thing or two. Read my top 5 ATS #implementation tips below! ------------------------------------------ 1. Define Success: Before your project begins, determine the metrics for which you will gauge success. Having success criteria to consistently return to helps elevate your team out of the minutia of configurations and into the larger strategic vision of your Talent Acquisition function. Be sure to measure the current status of these metrics so you have something to compare to following the implementation. 2. Gather The Team: Identify those that need to be involved in the implementation early. Don't forget about those that have an upstream and downstream impact from your ATS - this may include HR, Payroll, Department Leaders, and more. Using a RACI chart can be extremely helpful! Ask these members if they have used an ATS before and what they liked/disliked about their prior setup. Use these findings as you design your solution. 3. Separate the "Why" from the "What": Does the button need to be red and blinking or do you need to ensure the Hiring Manager doesn't forget to click the button? By presenting your consultant with simply the desired outcome, you create space for best practices and alternative creative solutions, rather than being met with "there's no blinking, red button option, sorry!" 4. Don't Over-Configure: In SaaS ATSs like #iCIMS that are so incredibly configurable, it is easy to get carried away, but it's important to remember that the 'out of the box' solution is usually the best solution. It is also what the vendor's documentation, training, and Help Desk is based upon. The further you get away from the standard setup, the harder it will be to manage and maintain your system long-term. 5. Test Along the Way: If there is one thing to remember from this list, it's how incredibly important testing is. If you wait to test till the end during User Acceptance Testing (UAT), I can guarantee you will end up extending your timeline, expanding your scope, and paying substantially more in implementation fees. Don't make this mistake! Your team should be testing weekly as each area of the platform is configured to get ahead of misunderstandings, product gaps, and undiscovered requirements. Test for failure AND success. E.g., when using #recruiting workflow entrance criteria make sure you can move the candidate forward when criteria are met, but also validate that you CANNOT move them forward if they have not yet been met. ------------------------------------------ What are some other implementation tips you'd add to this list? If you've ever worked with Workday's HCM and Payroll modules, you know that modeling company relationships isn't just about org charts—it's about legal structures, tax implications, and operational clarity. One of those nuanced areas? Common Paymaster vs. Common Pay Agent vs. Single Legal Entity ✅ Common Paymaster: A single entity pays employees who work across multiple related entities, combining tax limits on OASDI, Medicare, FUI, and SUI. ✅ Common Pay Agent: This is similar in concept, but the agent pays employees on behalf of multiple entities without the same tax benefits of a common paymaster. Honestly, this one still confuses me. ✅ Single Legal Entity: This structure provides location or division-level reporting and management without requiring additional FEINs. It is the simplest structure, but even here, complexities arise when employees support multiple business units. 💡 The challenge? Workday’s configuration must align with both legal reality and operational needs—from payroll processing to financial reporting to employee experience. These are not configurations you can change on a whim; you must plan. As companies grow and evolve, these relationships become more dynamic. Getting them right in Workday isn’t just a technical task—it’s a strategic one. Yesterday, a Director of IT reached out about their upcoming Workday Financials deployment. 2026 Q1 kickoff. Q4 projected go-live. Partner selection in progress. He asked: "Any advice on choosing the right implementation partner?" Here's what I told him (and what most executives don't realize): Don't get pressured by brand names. Big 4 firms aren't automatically better. They're often just more expensive. Mid-sized, Workday-focused partners often (can) deliver better results because: → You're a priority client, not account #647 → They customize the approach instead of running a factory model → Your team works with people who actually care about your success as they don't have the same brand leverage to build their reputation What to negotiate BEFORE you sign: 1. Resource approval rights (Some partners swap your leads mid-project. Lock this down.) 2. Test scenario support (Don't let them dump this on your team. They should co-create test cases with you.) 3. Extended hypercare (Push for 4-6 weeks minimum post-go-live support which can often be included without extra charge. The people who built it should help stabilize it.) 4. Milestone-based payments (Avoid time & materials. Tie payments to your acceptance criteria.) The bonus advice I gave him (that I'll share with you that read this far): Start cleaning your GL data NOW. Messy chart of accounts and incomplete historical financials are often the #1 cause of Finance deployment delays. Don't pay to play catch-up during implementation. Do the hard work before kickoff. His response: "Does it make sense for us to have a conversation?" That's what happens when you lead with value.
