This Privacy Policy (“Privacy Policy”) explains how SuccessFund, Inc. (“SuccessFund,” “us,” “our,” and “we”) processes your Data (as defined below). This Privacy Policy applies to everyone who uses our website at www.successfund.com, our mobile applications, touch technologies, electronic services, social networking sites, interactive features, online services, and Community Forum — or any of our described online activities we own or control, including any online activities owned, controlled, or operated by SuccessFund Affiliates (collectively, the “Services”). In addition, please review our Terms of Use at www.successfund.com/terms-of-use, which govern your access to and use of the Services. By using our Services, you agree to our Terms of Use and consent to our processing of your Data and other activities as described below.
By using the Services, you agree to the terms of this Privacy Policy. If you do not agree with the practices described in this Privacy Policy, please do not provide us with your Data or interact with the Services.
We may modify this Privacy Policy at any time. If we make any material changes, we will notify you by email (sent to the email address on file) or by means of notice on the Services prior to the change becoming effective. You can determine when this Privacy Policy was last revised by referring to the Effective Date above. To request a copy of the prior version, email support@successfund.com.

1. Types of Data We Process
We process Data, including Personal Information, when you interact with us and the Services, for example when you:
- access or use the Services;
- register, subscribe, or create an account with SuccessFund;
- open or respond to our emails;
- refer friends, family, or others to SuccessFund;
- contact customer service or use other customer support tools;
- provide Data to enroll or participate in programs offered on behalf of, or together with, Business Partners;
- visit any page online that displays our ads or content;
- make donations or payments on or through the Services;
- connect or link to any Services via social networking sites;
- post comments or questions to our Community Forum or other Online Communities;
- complete identity verification required to receive deposits; or
- provide Data to our partners, customers, or Affiliates.
This Privacy Policy does not apply to the processing of Data in any way other than as listed above or to Anonymized Data. We hold all rights in and may use Anonymized Data for our own purposes in any legal manner and without attribution or compensation to any person.
2. Lawful Basis for Processing
Many jurisdictions require that we disclose the lawful basis for our processing of your Data. In general, our lawful basis is your specific consent or your contract with us.
By accessing or using any of the Services, you consent to our processing of your Data as described in this Privacy Policy. If our processing is based on your consent, you may withdraw it at any time and we will cease processing your Data. However, doing so may result in your inability to access partial or full Services, and your withdrawal does not limit our ability to use Anonymized Data for legitimate business purposes. Withdrawal of consent does not prevent processing where we have a separate lawful basis or a legal obligation to retain the Data.
When you enter into an agreement with us — by registering for the Services, executing an agreement, or clicking “I Accept” or similar language — we will process your Data to fulfill the terms of that contract. In that case, withdrawal of consent will only be effective after the contract purposes have been fulfilled and after we no longer have a legal obligation to retain the Data.
In all cases, we will comply with applicable law and cease processing your Data after the legal right, obligation, or other lawful basis expires.
3. Your Choices
You can limit the Data you provide to SuccessFund and limit the communications SuccessFund sends to you.
(a) Solicitation Emails. You may choose not to receive solicitation emails from us by following the unsubscribe instructions in any solicitation email or by adjusting your email preferences in your account. Even if you unsubscribe from solicitation emails, we may still send you non-solicitation emails related to your account and transactions.
(b) Cookies and Other Technologies. You may manage how your browser handles cookies by adjusting its privacy and security settings. You can opt out of being targeted by certain third-party ad-servers using the National Advertising Initiative’s Opt-Out Tool (networkadvertising.org) or the Digital Advertising Alliance’s About Ads Opt-Out Tool (aboutads.info/choices). Where your browser or device transmits a Do Not Track signal, we will honor that signal by adjusting our Data processing practices accordingly, including limiting the use of certain tracking and advertising technologies.
(c) Device Data. You may manage how your device and browser share certain Device Data with SuccessFund by adjusting your device’s privacy and security settings. When you first visit or use the Services, we may request permission to process your Device Data using Automatic Processing Technologies. You can opt out of this processing, but doing so may limit certain functions or features of the Services.
(d) Emails from Business Partners. If you wish to opt out of receiving offers directly from our Business Partners, you can follow the opt-out instructions in the emails they send you.
4. How SuccessFund Processes Data
We (or our Business Partners or Vendors on our behalf) process Data as described in this Privacy Policy to:
- Operate, maintain, and improve the Services and Other Programs;
- Provide you with interest-based ads, push notifications, communications, and solicitations from us and participating Business Partners, including based on your precise geolocation;
- Facilitate and complete transactions on the Services and Other Programs;
- Evaluate your eligibility for certain types of offers, products, or services that may be of interest to you, and analyze advertising effectiveness;
- Answer your questions and respond to your requests;
- Perform analytics and conduct customer research;
- Communicate and provide additional information about SuccessFund and our Business Partners, sometimes by combining your Data with information from Other Sources;
- Send you reminders, technical notices, updates, security alerts, support and administrative messages, service bulletins, marketing messages, and requested information, including on behalf of Business Partners;
- Administer rewards, surveys, contests, or other promotional activities or events sponsored by us or our Business Partners;
- Manage our everyday business needs, such as administration of the Services, Community Forum management, fulfillment, analytics, fraud prevention, and enforcement of our corporate reporting obligations and Terms of Use, or to comply with the law;
- Allow you to apply for a job, post content, or sign up for special offers from merchants, Business Partners, or third parties through the Services and Other Programs;
- Verify your identity and organizational standing as required to enable direct deposit functionality; and
- Enhance other Data we have about you directly or from Other Sources to help us better understand you and determine your interests.
You provide us with your Data when you register, subscribe, create an account, make a donation, or otherwise interact with the Services and Other Programs. We also process Data when you contact us for customer service using self-help tools such as email, text, or by posting to an Online Community.
We also process Data from Other Sources in accordance with applicable laws. We use Automatic Processing Technologies to keep records, store your preferences, improve our advertising, and process Device Data about your interaction with the Services and our Business Partners’ websites. Device Data may be processed automatically as soon as your device interacts with the Services, even if you are not logged in.
We process your location Data, including precise real-time geolocation, through IP address lookup, GPS, Bluetooth, or WiFi signals, consistent with your device settings. Your device and our mobile apps may provide options to control how and when we process your geolocation. You may disable location services for the SuccessFund application in your device’s privacy settings.
If you use any features on the Services to send Data about a product or service to another person, we will also process the Personal Information of that other person to the extent disclosed by you and may contact them using the Data you provided. Consistent with our Terms of Use, you represent and warrant that you have obtained all necessary consents from any third party whose Personal Information you share with us.
5. When and Why SuccessFund Transfers Data
We (or our Business Partners on our behalf) may transfer your Data as required to perform the Services or as permitted by law:
- with any SuccessFund Affiliate, who may only process the Data for the purposes described in this Privacy Policy;
- with our Business Partners to provide Services for us, who are required to protect the Data;
- to report or collect on debts owed to us or our Business Partners;
- with relevant Business Partners: (i) for whom we process transactions; (ii) with whom we have entered into an agreement providing for the transfer of your Data; (iii) to facilitate a direct relationship with you; or (iv) to enable electronic communications with you as part of a donation, sponsored reward, offer, contest, or other activity in which you have elected to participate;
- with a purchaser or prospective purchaser of SuccessFund or any of the SuccessFund Affiliates (or all or a portion of their assets), as described in Section 12;
- to comply with legal orders and government requests, or as needed to support auditing, compliance, and corporate governance functions;
- to combat fraud or criminal activity, and to protect our rights or those of our Affiliates, users, and Business Partners, or as part of legal proceedings affecting SuccessFund;
- in response to a subpoena or similar legal process, including to law enforcement agencies, regulators, and courts in the United States and other countries where we operate; or
- with your consent.
We encourage Business Partners to adopt and post privacy policies. However, their processing of Data obtained through SuccessFund is governed by their own privacy policies and is not subject to our control or this Privacy Policy.
We may also transfer Device Data and Anonymized Data: for the same reasons we might share Data; with Business Partners for their own analysis and research; to facilitate targeted content and ads; or with Third-Party Ad-Servers to place our ads or ads of our merchants or Business Partners on the Services and on third-party sites, and to analyze ad effectiveness.
We do not directly share Personal Information with Third-Party Ad-Servers; however, Third-Party Ad-Servers may automatically process Device Data about your visit to the Services and other websites using Automatic Processing Technologies. This Privacy Policy does not cover the processing methods of Third-Party Ad-Servers. We encourage you to review their privacy policies. 6. Identity Verification Data
To enable direct deposit functionality, SuccessFund requires certain organizations, LEAs, NPOs, and Beneficiaries to complete identity and organizational verification through Persona, our third-party identity verification partner. In connection with this process, we and Persona may collect and process the following types of Data:
- Government-issued identification documents;
- Organizational legal status documentation and tax identification information;
- Bank account ownership verification information; and
- Any additional information required by applicable law or our banking or financial services partners.
Limited Use. Data collected through the identity verification process is used solely for: (i) verifying identity and organizational standing; (ii) fulfilling our legal and regulatory compliance obligations, including under applicable AML, BSA, and OFAC requirements; and (iii) enabling direct deposit functionality. SuccessFund will not use verification Data for marketing, advertising, or any purpose unrelated to the foregoing.
Third-Party Processing. Identity verification is performed by Persona. By completing the verification process, you consent to Persona’s collection and processing of your Data for verification purposes, subject to Persona’s own terms of service and privacy policy. SuccessFund does not control Persona’s data practices and encourages you to review Persona’s privacy policy before submitting verification information.
Retention. Verification Data is retained for as long as necessary to fulfill our compliance obligations and to support any regulatory audit or examination requirements. We will retain and use this Data as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.
7. Community Forum Data
SuccessFund provides a Community Forum through which registered Users across organizations may post questions, share information, and engage in discussions. The following data practices apply specifically to the Community Forum:
Public Visibility. Content you post in the Community Forum, including your name and affiliated organization, is publicly visible to all registered Users of the Platform. Do not post Personal Information in the Community Forum that you do not wish to be publicly visible.
@Mentions. The Community Forum includes an @mention feature that allows Users to reference other registered Users by name. By registering for the Platform, all Users consent to being @mentioned within the Community Forum. Use of the @mention feature does not constitute a transfer of Personal Information beyond what is already publicly visible on the Platform.
Content License. By posting content in the Community Forum, you grant SuccessFund the rights described in our Terms of Use, including the right to use, reproduce, distribute, and create derivative works from your content for any purpose, including marketing communications. Please review Section 9.4 of our Terms of Use for the full scope of this license.
Moderation. SuccessFund may monitor, review, and retain Community Forum content for the purposes of enforcing our Community Rules, complying with applicable law, and improving the Services. Content you delete from the Community Forum may be retained in our records for compliance and legal purposes.
8. Data Security
SuccessFund has implemented an information security program that contains administrative, technical, and physical controls designed to reasonably safeguard Data. For example, we do not directly process payment information; instead, we partner with industry leaders who follow industry standards for encryption technology to secure financial account information. No method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee absolute security. 9. Accessing and Correcting Data
You can access, update, and delete your Data by managing it through your online account or by emailing us at privacy@successfund.com. You can update or remove financial account information as well. Keeping your Data current helps ensure that we, our Affiliates, and Business Partners contact you with information most relevant to you.
If you want to deactivate your SuccessFund account or have other questions or requests, please contact us. While we are ready to assist you in managing your account and removing your active profile, we cannot always delete records of past interactions and transactions. We are required to retain records relating to previous purchases or donations for financial reporting and compliance reasons.
We will retain your Data for as long as your account is active or as needed to provide you services and to maintain a record of your transactions for financial reporting and tax reporting purposes. If you wish to deactivate your account or request that we no longer use your Data to provide you services, contact us at support@successfund.com. We will retain and use your Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
10. Social Networks
Social Community Areas
The Services may contain connections to areas where you may publicly post information, communicate with others, review products and merchants, and submit media content, including the Community Forum. Prior to posting in these areas, please read our Terms of Use carefully. All Data you post may be accessible to anyone with internet access, and any Personal Information you include in your posting may be read, processed, and used by others. We recommend that you do not post any sensitive Personal Information in social community areas.
Social Networks
You may log in to the Services using certain social network credentials. To manage the sharing of certain Data with us when you connect through social networking platforms or applications, refer to the privacy policy and settings of the social networking website or application. We are not responsible for the amount or nature of Data transferred from a social network to our Services.
You also have the option to link social networks, such as Facebook, to your SuccessFund account. Once you register with SuccessFund and connect with the social network, you may be able to automatically post recent SuccessFund activity back to your social network.
By proceeding through any of the above steps, you grant SuccessFund permission to access all elements of your social network profile Data that you have made available to be shared and to use it in accordance with the social network’s terms of use and this Privacy Policy.
11. Privacy Practices of Third Parties
This Privacy Policy only addresses the processing of Data by SuccessFund through your interaction with the Services. Other websites that may be accessible through links from the Services and Other Programs may have their own privacy statements and Personal Information processing practices. Our Business Partners may also have their own privacy statements. We encourage you to familiarize yourself with the privacy statements provided by these other parties prior to providing them with information or taking advantage of a sponsored offer or promotion.
12. Business Transfers and Corporate Changes
SuccessFund and our Affiliates reserve the right to transfer any and all Data related to the Services, including Personal Information:
- to a subsequent owner, co-owner, or operator of one or more of the Services or any portion or operation related to part of one or more of the Services; or
- in connection with a corporate merger, consolidation, or restructuring, the sale of substantially all of our stock or assets, or other corporate change, including, without limitation, during the course of any due diligence process.
13. Your Rights Regarding Your Data
Under applicable data protection, privacy, and other laws, you may have certain rights related to your access and control of your Data. Such rights may include:
- The right to access, correct, update, or request deletion of your Data.
- The right to object to or restrict the processing of your Data. Please note that exercising this right may limit or eliminate our ability to provide you the Services.
- The right to request portability of your Data.
- The right to opt out of marketing communications we send you. You can exercise this right by clicking the “Unsubscribe” or “Opt-Out” link in any such communication.
- The right to not be subject to a decision based solely on automated processing, including profiling.
- The right to submit a complaint to any applicable regulatory authority about our processing activities.
- The right to opt out of us sharing your Data, including for direct marketing purposes, subject to certain legal exceptions.
- The right to limit the use, disclosure, and processing of sensitive personal information as defined under applicable law.
We may use additional processes to verify your identity before we reveal or delete any of your Data. This list may not include all of your rights under applicable law. If you believe you have additional rights, please contact us at privacy@successfund.com.
Please note that exercising any of the above rights may limit or eliminate our ability to provide you the Services. We will try to comply with your request as soon as reasonably practicable and at the very least as required under applicable law.
A. Privacy for EU/UK Residents
The General Data Protection Regulation (GDPR), effective in Europe on May 25, 2018, requires that we clearly describe the Data we process and how we use it. This Privacy Policy does that. If you have any questions about our data processing, contact us at privacy@successfund.com. We comply with GDPR requirements to the extent they apply to us.
We are based in the United States. By accessing or using the Services or otherwise providing information to us, you understand that your information will be subject to processing in the United States and our other locations. Due to the nature of our Services, we typically act as a “Processor” as defined under the GDPR.
If you are a resident of the European Union, EEA, or United Kingdom, you have all applicable rights under the GDPR (and UK GDPR, as applicable), including the right to obtain confirmation of whether we maintain Personal Information relating to you. B. Privacy for California Residents
California adopted the California Consumer Privacy Act (“CCPA”), effective January 2020, and the California Privacy Rights Act (“CPRA”), fully effective January 1, 2023. We comply with the requirements of the CCPA and CPRA to the extent they apply to us.
If you are a California resident, you may request to exercise your rights for any Data we have processed in the 12 months prior to your request. You can exercise your rights free of discrimination — we cannot increase the price or decrease the quality of the Services because you exercise your rights.
Due to the nature of our Services, we typically act as a “service provider” as defined under the CCPA and CPRA. If you believe this role should be defined differently, please contact us at privacy@successfund.com.
C. Other Jurisdictions
We strive to comply with all applicable data protection and privacy laws in applicable jurisdictions. If you have questions about your rights under any applicable data protection laws, please contact us at privacy@successfund.com.
14. Children’s Privacy
The Services are not directed at children under the age of 13. By accessing our Services, you represent that you are at least thirteen years old. You must be at least eighteen years old to create a Business Partner or Affiliate account and at least thirteen years old to make a payment through the Services.
SuccessFund’s Services are directed to adult organizers, administrators, and supporters operating in school and educational contexts, not to students directly. Organizers using the Services in a K–12 environment are solely responsible for ensuring their use of the Services complies with all applicable laws governing student data privacy, including the Children’s Online Privacy Protection Act (“COPPA”) and the Family Educational Rights and Privacy Act (“FERPA”). SuccessFund assumes no responsibility for Organizer compliance with student data privacy laws.

16. Glossary of Terms
“Anonymized Data” means any information that does not relate to an identified or identifiable individual, or Personal Information rendered anonymous in such a manner that the individual is not or no longer identifiable.
“Affiliate” means an entity owned, directly or indirectly, by SuccessFund, or that is controlled by or under common control with SuccessFund, and also includes joint ventures entered into by SuccessFund or its Affiliates. References in this Privacy Policy to “SuccessFund,” “we,” or “us” also apply to Affiliates.
“Automatic Processing Technologies” means Cookies, Pixel Tags and Web Beacons, and Device Data.
“Business Partners” means, collectively, third parties with whom we conduct business, such as merchants, co-marketers, distributors, resellers, school districts, education-related organizations, and other companies or organizations with whom SuccessFund enters into agreements to support its business and operations.
“Community Forum” means the public discussion and community engagement feature on the Platform through which registered Users across organizations may post questions, share information, and engage with one another.
“Cookie” means a unique identifier, usually made up of small bits of text or code.
“Data” means all information we process that relates to you and your use of the Services, including Personal Information.
“Device Data” means information concerning a device you use to access, use, or interact with the Services, such as operating system type or mobile device model, browser type, domain, and other system settings, the language your system uses and the country and time zone of your device, geolocation including precise geolocation, unique device identifier or other device identifier, advertising identifier, mobile phone carrier identification, and device software platform and firmware information.
“Online Communities” means, collectively, our social networking pages or accounts, Community Forum, forums, bulletin boards, discussion groups, chat rooms, or other methods of communication that may be offered on or linked through the Services.
“Other Programs” means special programs, features, and functionality on our Services or other co-branded websites with Business Partners that we reasonably control and that have special use terms applicable to such programs, features, and functionality.
“Other Sources” means sources of information that legally provide SuccessFund with your Data, and which are outside the scope of this Privacy Policy at the time of processing.
“Personal Information” means information about you that specifically identifies you or, when combined with other information we have, can be used to identify you. This includes but is not limited to:
- Contact Information: your name, postal addresses, email addresses, social networking website user account names, telephone numbers, or other addresses at which you are able to receive communications.
- Relationship Information: information you provide that enables us to determine your job title, relationship with the school or parent organization, lifestyle, interests, and activities, including location information related to your state/province, city, or neighborhood; areas of interest; the types of organizations, initiatives, events, and groups that interest you; information processed through your interactions with social networks; demographic information (e.g., birth date, age, gender); information about persons for whom you have made payments; and information about friends who refer you or whom you have referred.
- Transaction Information: information you provide when you interact with us and the Services, such as the SuccessFund campaigns you are interested in and make payments to; email and other communications; and how you interact with Business Partners and our Vendors.
- Financial Information: information collected from you as needed to process payments or donations, such as your payment card number, expiration date, and card verification number.
- Identity Verification Information: government-issued identification documents, organizational legal status documentation, tax identification information, and bank account ownership verification information collected through the Persona identity verification process.
“Pixel Tags” and “Web Beacons” mean tiny graphic images placed on website pages or in our emails that allow us to determine whether you have performed specific actions.
“Third-Party Ad-Servers” means Vendors and other third parties that provide the technology to place ads on websites and track ad performance.
“Vendors” means, collectively, third parties that perform business operations on behalf of SuccessFund, such as transaction processing, billing, mailing, communications services, marketing, data processing and analytics, servicing, collections, ad management, or information technology services.
