This is a groundbreaking filing by TRIAL International, Pan African Lawyers Union (Official), and FIDH - International Federation for Human Rights. To date no international or regional #HumanRights mechanism has addressed #State #accountability for #atrocities committed by #mercenary groups such as #Wagner. National prosecutions focus on individuals committing crimes of #mercenarism. It will be extremely interesting to see how the African Court on Human and Peoples' Rights responds and whether #justice is possible for the #victims of these #atrocities.

The case that my colleagues at TRIAL International and our partners at FIDH - International Federation for Human Rights and #PALU have worked on is novel in that it seeks to engage State responsibility for hosting and collaborating with private military and security actors. It raises fundamental questions about how human rights obligations apply when States rely on transnational armed actors operating in opaque and fluid structures. While directed against Mali, the proceedings go beyond a single national context. They reflect a broader shift: the growing need to clarify the legal framework governing private military actors and to ensure that their involvement does not dilute the protection owed to civilians. This may be a decisive moment to confront the accountability gap surrounding private military and security companies, and to reinforce that human rights obligations remain fully applicable regardless of the actors involved.
