ESMA Final Report: Extension of the alleviated format for insider lists - what is changing? On 21 October 2025, the European Securities and Markets Authority (ESMA) published its Final Report on draft Implementing Technical Standards (ITS) extending the alleviated insider list format to all issuers under the Market Abuse Regulation (MAR). The proposal follows the Listing Act adopted in November 2024 and has been submitted to the European Commission, which is expected to decide on its adoption within three months. What is changing in practice? The new alleviated format removes several data fields from the standard insider list templates. For the event-based section, issuers will no longer need to include: (i) surname(s) at birth (if different), (ii) company name and address of the insider, (iii) personal telephone number, and (iv) personal full home address. For the permanent section, the removed fields are: (i) surname(s) at birth (if different), (ii) personal telephone number, and (iii) personal full home address. Additionally, issuers will only need to provide either the National Identification Number or the date of birth of insiders - not both as previously required. Simplified approach for external service providers ESMA clarifies that issuers will only need to include one natural contact person per external service provider with access to inside information. This approach reduces administrative burdens whilst maintaining traceability for supervisory authorities, as third-party providers remain obliged to draw up their own insider lists. Important clarification on permanent vs. event-based lists ESMA confirms that the permanent section of the insider list should not be read as cumulative to the event-based section. In other words, persons included in the permanent section do not need to be separately listed on event-based insider lists for specific pieces of inside information. However, it remains unclear whether this means that if all persons with access to inside information are included on the permanent list, no event-based list needs to be maintained at all. This interpretation would differ from current Danish FSA guidance. The practical implications of this clarification therefore remain uncertain, and issuers may wish to await further guidance before adjusting their current practices. (4)Faithfulness (or Groundedness)--Measures if the generated response is factually supported by the retrieved documents, minimizing hallucination. (5)Helpfulness--An end-to-end metric that assesses how well the final response helps the user achieve their goal. (6)Consistency--Ensures the system provides high-quality responses consistently across different queries and contexts.
