Georgia’s film industry continues to play a major role in job growth and economic development, and our own Peter Stathopoulos, Partner in our State & Local Tax practice and Entertainment lead, was quoted in today’s Atlanta Journal-Constitution article on the competition between Georgia and California for film productions. As the article notes, Georgia recently streamlined its film tax credit process, revived a standalone post-production credit, and made it easier for production companies to monetize credits faster. The matter concerned the film Animal, directed by Sandeep Reddy Vanga and featuring Ranbir Kapoor, one of the highest-grossing films of 2023. Cine1 Studios, co-producer of the film, initiated proceedings before the Hon’ble Delhi High Court regarding the movie’s OTT release. Cine1 alleged that Super Cassettes Industries (T-Series) breached the co-production agreement by failing to share revenues, accounts, and derivative/IP rights despite Cine1’s 35% stake. T-Series countered that Cine1 had relinquished its rights in a 2022 amendment in exchange for ₹2.6 crores. Justice Sanjeev Narula issued summons to T-Series, Netflix, and Culver Max Entertainment, directing pleadings and affidavits. The proceedings carried into early 2024 and ended in an out-of-court settlement shortly before the scheduled OTT release. Key issues raised: - Enforcement of profit-sharing and IP rights in high-value co-productions - Alleged breach of contractual obligations and disclosure of revenues - OTT release disputes in the backdrop of blockbuster box-office success The case underscores how contractual disputes in the film industry are increasingly tested at the intersection of theatrical revenue and OTT distribution.
