Until recently, most in-house legal teams treated AI as a back-office tool, useful for automating NDAs, triaging intakes, or accelerating eDiscovery. That era is ending. We’re now entering a new phase where AI is beginning to shape legal strategy itself. From surfacing litigation risks buried in contract portfolios to forecasting regulatory exposure before it lands, AI is moving closer to the decision-making core of the legal function. This shift brings both promise and pressure. For GCs, it means rethinking legal operations as more than support infrastructure. It means asking tougher questions: What institutional knowledge can we train models on today? Where are we still reactive when we could be predictive? Are we structured to test and adopt emerging tech without compromising governance? The legal teams leading this shift aren’t just adopting tools, they’re building internal playbooks for AI-readiness, integrating cross-functional data, and putting guardrails in place now that will shape what AI can and cannot do tomorrow. For folks using Generative AI, be wary of seemingly accurate yet incomplete responses. While AI tools seem to excel at often producing technically correct information, they are also limited by their dataset and often miss critical context and nuance. Consider legal research tools that correctly cite laws but overlook recent precedents that completely change the case outcome. This isn't about AI being wrong; it's about AI being right in ways that aren't quite right enough. This incompleteness challenge stems from fundamental limitations: training data that inevitably becomes outdated, algorithms that struggle to distinguish essential from ancillary information, and the black box problem where we can't see what's been omitted. Rather than viewing this as a roadblock to AI adoption, smart professionals are recognizing it as an opportunity to develop crucial verification and supplementation skills. We should be less focused on AI replacing human judgment and more mastering combining AI with context and judgment. Most legal teams are still just scratching the surface of what AI can do. Think about how much time is spent reviewing and summarizing documents, extracting key facts, building timelines, cross-referencing witness testimonies, and checking for contradictions across massive data sets. AI is streamlining all of that. For litigators especially, tools like Ask iManage are unlocking new efficiencies. Instead of sifting manually through thousands of pages, they can use AI to generate timelines, surface inconsistencies, and ensure that nothing important slips through the cracks. Even in situations where documents are barely legible — like handwritten land titles — AI is able to scan, interpret, and deliver a clear overview. Your playbook says no IP infringement warranty — because you already offer an indemnity for third-party IP claims. Makes sense in theory: indemnity is the more appropriate remedy for such claims. But the customer wants both. You can’t afford another 2-day internal “go/no-go.” A possible middle path: Provide the warranty, but limit the remedy to the indemnity clause — i.e., if there’s a breach of the IP warranty, the sole and exclusive remedy is the existing IP indemnity. When budgets tighten, in-house IP teams are often told to “use AI to cut costs.” For patent and IP lawyers, the real question is how to do that without undermining enforceability, trade secret protection, or privilege. In a new piece for Managing IP I share a practitioner’s roadmap for IP counsel which we use also at Glean to treat generative AI as an enterprise tool in the innovation cycle; run sensitive workflows on enterprise-grade platforms with no-train, no-retain commitments; and build governance that matches how inventors and outside counsel actually work, including documentation of human inventorship and prompts. If you’re advising inventors or managing a patent portfolio, here are a few themes I’m seeing in practice: 🔹 Use AI to accelerate claim drafting, prior-art review, and portfolio analysis 🔹 Assume consumer-facing tools are incompatible with trade secret “reasonable measures,” cross-border data-transfer rules, and litigation hold obligations 🔹 Build AI vendor diligence into your IP risk model: security, privacy, and AI-governance standards (SOC 2, ISO 27001, ISO 42001), data isolation, and clear DPAs/NDAs 🔹 Pair policy with practice: training for inventors and IP teams, plus secure enterprise AI platforms embedded into your invention disclosure, prosecution, and IP workflows Full article linked below, and on my LinkedIn profile: https://lnkd.in/gNScYKkT
