PSA: The best conversations don't always happen on stages... sometimes, they start with sticky notes! 📝 Last week, I had the opportunity to lead a roundtable discussion with co-host, Benjamin Alred, at the inaugural WIPR - World IP Review AI & IP Summit in NYC. The topic was a big one: “Leveraging AI to maximize the power of IP as a cross-functional asset in your organization”. To make sure the conversation didn't get dominated by a few loud voices (always a risk!), we borrowed an idea I loved from The LegalTech Fund's Corporate Legal Retreat earlier this year. Everyone at the table rapid-fire jotted down their thoughts independently, first on how AI is currently being used in their IP processes; then on how they imagine their organizations and the IP ecosystem functioning wayyyyy into the future - just kidding, we targeted 10-15 years from now. It's all relative, right! The present was exactly what you might expect! A flurry of great tools, mostly point solutions. A bit of connectivity here and there (often IP and R&D, or IP and the C-suite), but the relationships were shallow and mostly one-directional. The future, though, looked radically different. The room imagined seamless workflows spanning ideation to monetization, heavy automation, and even some speculation about patent office processes running with little to no human involvement. Whether that future is desirable from the group's vantage point... the jury is still out on that one! 😅 The exercise was simple but the contrast was striking. Today, we have an ecosystem that’s diverse yet fragmented. Tomorrow, we might have one that’s wholly interconnected, automated, and operating at a completely different scale. The point is, we’re still just scratching the surface of what's possible. And if this conversation is any indication, we've got a brave new world ahead!!

"How would you describe the current state of privacy enforcement in the U.S.?" asked ALM tech reporter Ella Sherman, kicking off the #Legalweek25 session entitled "Navigating the Complex Landscape of Privacy Enforcement and Litigation." Kathleen Scott of Wiley Rein LLP answered first, "The two words that come to mind right now are 'active' and 'fragmented.' We've seen an incredible uptick in privacy enforcement, both in terms of regulatory enforcement and litigation across the board. We're seeing privacy laws not just sitting on the books but being actively enforced by a number of state AGs. There's ongoing federal activity, including federal enforcement, despite the big changes happening at the agency level of the federal government right now. On the fragmented side, I think the fragmentation is the most noticeable feature of the current enforcement landscape. You have so many actors and enforcers who are scrutinizing activities and incidents, and it really is a grab bag." Cobun Zweifel-Keegan, J.D., CIPP/US, CIPM of IAPP added another word: "expanding." "We've seen that both on the rulemaking side and the enforcement side. In almost every category, we keep seeing expansion and regulatory interpretations. We also have more and more cops on the beat." From the cyber side, Anna Rudawski of A&O Shearman noted what she saw as a "de-emphasis of personal information from a cyber standpoint. Personal data is now just an asset class you're trying to protect. "I would say even in this ransomware and threat environment," she continued, "we see threat actors targeting more sensitive data to extort ransom." Covering a range of topics from geolocation to connected cars, the question remained: What's the best approach to building resilient privacy infrastructure and compliance programs in an enforcement arena where nobody can feel safe? "Just keep up," Scott said. "Monitor developments, because everything is happening in real time. Things change on a daily basis, and they matter for your compliance program and they matter for your risk profile. It's a huge undertaking but critical to your ability to develop a thoughtful and risk informed compliance strategy." Zweifel-Keegan emphasized the importance of thinking like a regulator. "If there's a story to be told about how personal data can be used to extract money from consumers, or prices might be raised because of how personal data is being used, that's where the regulator ends up being on higher ground in telling a compelling story that puts companies at a disadvantage. Running that kind of analysis around new products and services is really a helpful first step." "It's not that you get everything right, it's that you are getting most of it right," Rudawski said. For folks using Generative AI, be wary of seemingly accurate yet incomplete responses. While AI tools seem to excel at often producing technically correct information, they are also limited by their dataset and often miss critical context and nuance. Consider legal research tools that correctly cite laws but overlook recent precedents that completely change the case outcome. This isn't about AI being wrong; it's about AI being right in ways that aren't quite right enough. This incompleteness challenge stems from fundamental limitations: training data that inevitably becomes outdated, algorithms that struggle to distinguish essential from ancillary information, and the black box problem where we can't see what's been omitted. Rather than viewing this as a roadblock to AI adoption, smart professionals are recognizing it as an opportunity to develop crucial verification and supplementation skills. We should be less focused on AI replacing human judgment and more mastering combining AI with context and judgment.
