On Friday, March 21, the California Civil Rights Council adopted final employment regulations regarding automated decision systems. These regulations apply broadly to employers, employment agencies, and "agents" (newly defined). There is a broad definition of "automated decision systems" and a retention period of 4 years for "automated decision data" (also newly defined). The new regulations make it unlawful to "to use an automated-decision system or selection criteria (including a qualification standard, employment test, or proxy) that discriminates against an applicant or employee or a class of applicants or employees on a basis protected by the Act..."
