USCIS’s recent Policy Memorandum on Adjustment of Status is less about changing the law and more about changing how discretion is applied. In our latest alert, we unpack what this means in practice: heightened scrutiny, more rigorous review of immigration history, and an increased likelihood of RFEs and discretionary analysis in adjudications.
