Earlier this month, members of the firm’s International Services Team hosted alumni of our Foreign Legal Internship Program (FLIP) in Berlin for a day of informative sessions, networking, and a festive dinner. Now in its 27th year of hosting up to eight students annually, #FLIP has a robust, active alumni network, whom the firm invites to a reunion every other year at a different city. Through FLIP, German and other law school graduates spend part of their legal internships with #FBTGibbons in New York for three-month rotations, gaining an in-depth overview of the U.S. legal system. This year’s FLIP reunion in Berlin struck the perfect balance between professional focus and community building. Many thanks to our FBT Gibbons presenters, including Aaron Bernay, Brian DiBenedetto, Jason Tonne, and Peter Flagel, along with our FLIP program director, Myriam Rastaetter. We also had the honor of hosting guest speaker Dr. Thomas Kremer, who took part in a panel discussion comparing U.S. and German approaches to shareholder control, parent company liability, and director fiduciary duties. It was a pleasure to co-author, with my FBT Gibbons partner Larry Lustberg, an article for the April 2026 issue of the New Jersey State Bar Association's New Jersey Lawyer magazine. The issue is titled "The Rule of Law." Larry and I wrote about the U.S. Supreme Court's increased use of its "shadow docket" to issue substantive rulings through emergent orders. Our article explains that these decisions, often issued without clear (or sometimes any) legal reasoning, raises questions about the institution's legitimacy, which is essential to the rule of law in our constitutional system.
