A copyright infringement notice isn’t something to ignore. If your business receives a demand letter over a photo, music clip or other content used online, the next step shouldn’t be the trash can. It should be a prompt, careful review. What to review first: - Investigate where the allegedly infringing content came from. - Confirm whether your business has a valid license to use the work. - Assess potential defenses, including wrong party, wrong work or authorized use. - Review whether advertising injury insurance may provide coverage. - Check vendor contracts to see whether a web designer or outside provider may be responsible. Many copyright demand letters involve website content, stock photos, music snippets or materials added by third-party vendors.
