Who we are
Big Duck Games, LLC (“Big Duck Games,” “We,” or “Us”) collects, uses and is responsible for certain personal information about you, as part of providing the Big Duck Games website and our mobile applications (collectively, the “Service”).
For European Economic Area or United Kingdom residents, we are regulated under the General Data Protection Regulation (GDPR) and UK GDPR, and we are responsible as controller of that personal information for the purposes of those laws. This means we determine how and why your data is processed.
What’s in this Privacy Policy?
This privacy policy covers two different versions of our games with very different privacy practices.
Which version are you using?
Free, ad-supported games (standard app stores) and our website - covered in Part 1
Premium, ad-free games (Apple Arcade, Amazon Kids+, educational platforms) - covered in Part 2
While our premium games remove ads and limit collection of personal data, our free games use advertising to support development, which means we collect and share certain data with partners to show you relevant ads. This policy explains exactly what we do and how you can control your information.
Additionally, Part 3 explains additional privacy-related policies and other information which apply across the Service.
Part 1: Free, Ad-Supported Games
First, we’ll discuss our data privacy policies for our free, ad-supported games available through standard app stores (the “Free Games”) and the collection of contact information if you sign up for our newsletter or contact us directly.
What Personal Information do we collect?
In the course of providing you with the Free Games, we collect the following personal information, either automatically or when you explicitly provide it to us:
Contact Information: Your name and email address, if you sign up for our newsletter or contact us for customer or technical support. For those users who are subject to the GDPR or UK GDPR (see the section entitled “Your personal data rights” below), or where consent is otherwise required by applicable privacy laws, the legal basis for collecting this information is your explicit consent, under GDPR Art. 6 (1) (a).
Analytic Information: Your IP address, browser type, and information about your gameplay and activities on the Free Games are collected automatically while you use the games. For those users who are subject to the GDPR or UK GDPR, the legal basis for collecting this information is our legitimate interest, under GDPR Art. 6 (1) (f).
Advertising Information: Your unique Advertising ID. For those users who are subject to the GDPR or UK GDPR, or where consent is otherwise required by applicable privacy laws, the legal basis for collecting this information is your explicit consent, under GDPR Art. 6 (1) (a).
What we use this Information for
We use your personal information as follows:
Your Contact Information is used to communicate with you about game-related issues (including receiving and responding to communications that you send us through the games), respond to customer and technical support inquiries, and to send you communications about new products and services.
Your Analytic Information is gathered and pooled with other users’ data, and used for the purposes of improving our games, such as tracking the total number of users or visitors to the games, their aggregate activities on the games, gameplay data and other gameplay analytics, and tracking the sites that refer visitors to Big Duck Games.
Your Advertising Information is used to display personalized advertisements on the Free Games (see “How we share Information” below for more information).
How we share Information
We share your personal data with certain third parties as part of our operation of the Free Games, whether shared by us or gathered directly by third parties through SDKs integrated into the Free Games. This data sharing enables us to provide you with the Free Games in the optimal way, such as serving you personalized, relevant advertisements within the games.
We keep a list of these third parties that we share personal data with and who process personal data on our behalf, on our Subprocessor List which you can access at this link. We update this list from time to time, to include the latest information about the subprocessors we use.
Advertisements: Some of your personal data, such as your Advertising Information, is shared with advertisers to display advertisements on the Free Games that are relevant to your interests. We may add and remove advertisers from time to time. An updated list of these third-party advertisers is contained on our Subprocessor List.

Newsletters: If you opt in to our newsletter, your name and email address may be shared with our newsletter provider listed on our Subprocessor List.
Analytics: We may use third party website and mobile application analytic tools on the Free Games, that employ cookies and other tracking methods (such as tracking pixels) to collect certain information concerning your use of the games. These third party tools are listed on our Subprocessor List.
Other Sharing: We will share your personal data if we have a good faith belief that (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities, (ii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the games, or (iii) such action is appropriate to protect the rights, property or safety of Big Duck Games, its employees, clients, or users of the games.
Part 2: Premium, Ad-Free Games
Now, we’ll discuss our data privacy policies for our premium games available through app stores such as Apple Arcade, Amazon Kids+, and educational versions (the “Premium Games”).
What Personal Information do we collect?
First, we’ll discuss what we don’t collect. We don’t collect personal data in these Premium Games without your explicit consent.
Players can enjoy our Premium Games safely without worrying about their privacy. We’ve designed our Premium Games to avoid any automatic or involuntary collection of any personal data. Any game progress and other game-related information is stored on your device and not collected by us.
We don’t collect names, addresses, or any contact information, unless you contact us first for customer or technical support (the legal basis for collecting this information is your consent, under GDPR Art. 6 (1) (a).) Otherwise, we don’t collect email addresses, phone numbers, photos, videos, or audio recordings. We don’t track your location, and we don’t use persistent identifiers that would allow us to track players across apps or websites.
Now, we’ll discuss what we do collect. For our Premium Games, any data collection and sharing must be initiated by you. For example, if you contact us directly, including for customer or technical support, we will only collect and use your personal information for that purpose. You may also choose to publicly share game screenshots, progress, and other gameplay information through your device’s sharing functionality.
How we share Information
We share data only in very limited circumstances, when required by law or when necessary to comply with subpoenas, court orders, or other legal processes.
For Apple Arcade Users
In addition to the sharing described elsewhere in this Privacy Policy, we also share gameplay data from Premium Games with Apple, as part of their platform operations. If you choose to opt in to certain data sharing through your Apple device, you may share basic usage and crash data with us, share certain data with Apple Game Center for achievements, and with Apple iCloud to sync progress across devices.
We may also share data with Apple-approved service providers who process data on our behalf (such as for cloud storage or technical support), but only under strict contractual restrictions. These service providers are prohibited from using the data for their own purposes and can only use it according to our written instructions. They cannot share the data further.
If required by law, or if necessary to comply with subpoenas, court orders or other legal processes, we may share data to the extent required.
Additionally, any data retention by us will comply with Apple’s requirements.
Your choices about data collection
You can decline to provide certain data through your device settings, but this may limit some Premium Game features.
For example:
If you decline to allow the game to store cloud sync data, you may lose game progress when you switch to another device
If you decline certain permissions, some gameplay features may not be available
The core single-player experience remains available even if you decline optional data collection
You can also withdraw permission after initially providing it, through your device settings. We respect your choices about data collection.
No third-party services
These Premium Games are intentionally isolated from third-party services. We don’t include advertising networks, analytics tools from other companies, or any third-party tracking technologies.
The platform providers (such as Apple, Amazon, and others we offer the Premium Games through) handle all payments and subscriptions according to their own privacy policies, which means we never see or collect payment information.
How we keep players safe
In order to keep players of all ages safe while using our Premium Games, we’ve built in several protections:
No in-app purchases within the Premium Game itself
No chat features or ways to communicate with other players
No collection of photos, videos, or location data
The platforms themselves provide additional layers of protection, such as parental controls that you can use to further manage the experience. All payments and subscriptions go through the platforms’ secure systems, never through us directly.
Premium Game data retention
We retain personal data we collect through the Premium Games only as long as necessary to provide the services and comply with legal obligations.
Part 3: General Service privacy terms
The following terms apply across the Service, including to our Free Games, Premium Games, and our website.
How we secure personal data
We take security seriously and have taken reasonable measures to protect any personal data we collect.
Access to any data is strictly limited to essential personnel at Big Duck Games who need it to maintain and improve the Games. Personal data is encrypted during transmission to prevent unauthorized access.
We have procedures in place, in the event of a data breach. We will assess any suspected breach and notify our users and the relevant authorities according to the applicable law.
Children under 13
We do not knowingly collect personal information from children under the age of 13 (or the equivalent minimum age in your jurisdiction). If we discover that we have inadvertently collected personal data from a child under 13 without parental consent, we will take reasonable measures to promptly delete such data from our records.

For California Residents
Under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), you have the right to:
Know: Request details about personal information we’ve collected over the past 12 months
Delete: Request deletion of personal information, subject to certain exceptions (such as completing transactions, security purposes, or legal compliance)
Correct: Request correction of inaccurate personal information
Opt-Out: Opt out of the “sale” or “sharing” of personal information for cross-context behavioral advertising
Limit Use: Limit use of sensitive personal information to providing requested services
Non-Discrimination: You will not be discriminated against for exercising these rights
Minors Under 16: We do not knowingly sell or share personal information of users under 16 years of age.
Shine the Light Law: California Civil Code Section 1798.83 permits California residents to request information about disclosure of personal information to third parties for their direct marketing purposes. If you have questions about this, you may contact us at support@bigduckgames.com.
Data Retention: We retain the minimal technical data we collect for a reasonable time after you delete the Game, or as long as necessary to provide the services and comply with legal obligations. California residents can request information about our retention practices by contacting us.
For US residents in states with comprehensive privacy laws
If you live in a state with a comprehensive privacy law (like Virginia, Colorado, Connecticut, Utah, Oregon, Texas, and Montana), you may have the right to:
Confirm whether we’re processing your personal data and access that data
Request correction of inaccuracies in your personal data
Request deletion of your personal data
Obtain a copy of your personal data in a portable format
Opt out of sale of personal data and targeted advertising (we do not engage in these practices)
For Canadian Residents

Authorized Agents
You may designate an authorized agent to make requests on your behalf. We may require written proof that you authorized them to act for you, and we may also require you to verify your identity directly with us.
Changes to this Privacy Policy
We may update this Privacy Policy from time to time as the Service evolves or as legal requirements change. When we make changes, we’ll post the new policy with an updated date at the top.
If we make significant changes that affect how we handle information, we’ll notify you through the platform or by other appropriate means, if we have your contact information and notifying you is reasonably possible.
