Governor Arnie to EPA: Hasta La Vista, Bureaucratic Delay Monkeys

Arnie California is poised to sue the Environmental Protection Agency for dragging its bureaucratic feet over the state's proposed restrictions on automotive greenhouse gas emissions.

The law was passed in 2002, but -- because the restrictions are tighter than those mandated by the federal government -- couldn't take effect without an EPA waiver. In 2005, California formally asked the EPA to review the law, but received no decision. Six months ago, California governor Arnold Schwarzenegger said that the agency had until today to act. If they didn't, he promised to sue them -- and it looks like that will happen this week.

If successful, fourteen similarly-delayed emissions laws passed by other states will have a green light -- which could explain, perhaps, why the automotive industry has fought the laws tooth-and-nail, and why the EPA is so reluctant. But as the San Jose Mercury News explains, the law is on Arnie's side, as is public opinion; the question is whether or not the battle will be settled quickly, or after years of taxpayer-funded litigation and continued pollution.
