The "Good Employer" Paradox 🤯 Paradox I'm seeing in SME HR: The BETTER your culture = The WORSE your CCMA outcomes. Wait, what? 🤔 Here's what's happening - "Good Employer" Mindset: → We treat our people fairly (informal approach) → We have open-door policy (flexible on procedures) → We give second chances (inconsistent consequences) → We don't want to be "that kind" of employer (under-document everything) → Our team knows we care (relationship over process) 💼 CCMA Reality: They don't care about your culture. They care about procedural fairness. Real case example: Company: Amazing culture. 4.8 Glassdoor rating. Wellness programs. Flexible hours. Team lunches. Incident: Had to dismiss long-term employee for repeated tardiness (12+ warnings given verbally over 2 years). Their thinking: "We bent over backwards. Everyone knows we tried." CCMA ruling: Unfair dismissal. Why? → Warnings not formally documented (verbal ≠ valid) → No clear escalation policy applied → Inconsistent (some staff late without warnings) → No formal PIP before dismissal Cost: R156,000 + reinstatement. 💸 The paradox: Their kindness became legal liability. We say: “2026 is the year HR stops talking about ‘the future of work’ and starts dealing with its consequences.” But it's not just our opinion, here’s what the data is telling UK HR leaders right now: 1️⃣ Engagement is at crisis levels Gallup data reported in People Management shows just 10% of UK workers feel engaged - one of the lowest rates in Europe. . Low engagement isn’t a comms problem. It’s a strategy, leadership and job-design problem. 2️⃣ AI will reshape headcount - ready or not The CIPD’s latest Labour Market Outlook finds 1 in 6 UK employers expect AI to reduce their workforce in the next 12 months, with junior clerical and professional roles most at risk. This makes reskilling, career pathways and internal mobility a business continuity issue, 3️⃣ Reskilling beats wellbeing as the top HR challenge A 2025 study reported in People Management shows reskilling and internal mobility have overtaken wellbeing as the number one HR challenge, as organisations grapple with persistent skills gaps. 4️⃣ Wellbeing 2.0: from perks to absence and job quality CIPD research shows sickness absence is at its highest level in over 15 years, with mental health and stress leading the reasons for long-term absence. This demands a shift from yoga apps to workload, management capability and job design.
