This legal notice sets out the general conditions governing access to and use of this website, hereinafter referred to as ‘the website.’ Use of the website implies the express and full acceptance of these general conditions in the version published at the time of access, without prejudice to any specific conditions that may apply to certain services of the website.

Access to the website is free of charge, except for the cost of the connection through the telecommunications network supplied by the access provider contracted by the users. Certain services are exclusive to our clients and access to them is restricted.

Comunica.DK-Translations, S.L is the owner or licensee of all intellectual and industrial property rights of its website, as well as of the elements contained therein. Therefore, the reproduction, distribution, public communication or transformation of all or part of the contents of this website for commercial purposes, in any format and by any technical means, is expressly prohibited without the authorisation of Comunica.DK-Translations, S.L in its Terms and Conditions.

The trademarks, trade names, or distinctive signs are the property of Comunica.DK-Translations, S.L, whether by virtue of industrial or intellectual property rights, and access to the Portal shall not be understood as conferring any rights over said trademarks, trade names and/or distinctive signs.

All products and services on these pages that are NOT owned by Comunica.DK-Translations, S.L are registered trademarks of their respective owners and are acknowledged as such by our company. They appear on the website of Comunica.DK-Translations, S.L solely for promotional and informational purposes. These owners may request the modification or removal of the information that pertains to them.

3. Conditions of Use of the Portal 

3.1 General 

The User undertakes to make proper use of the Portal in accordance with the Law and this Legal Notice. The User shall be liable to Comunica.DK-Translations, S.L or to third parties for any damages that may arise as a consequence of failing to comply with this obligation.

The use of the Portal for purposes detrimental to the property or interests of Comunica.DK-Translations, S.L or third parties, or in any way that overloads, damages, or disables the networks, servers and other computer equipment (hardware) or software products and applications of Comunica.DK-Translations, S.L or third parties, is expressly prohibited.

3.2 Content

The User undertakes to use the Contents in accordance with the Law and this Legal Notice, as well as with any other conditions, regulations and instructions that may apply pursuant to Section 1. By way of example, and in accordance with current legislation, the User must refrain from:

  • Reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the Contents, except in cases authorised by law or expressly consented to by Comunica.DK-Translations, S.L or by the holder of the exploitation rights, as applicable.
  • Reproducing or copying for private use any Contents that may be considered Software or Databases under current intellectual property legislation, as well as publicly communicating or making them available to third parties when such acts necessarily involve reproduction by the User or by a third party.
  • Extracting and/or reusing all or a substantial part of the Contents of the Portal, as well as the databases that Comunica.DK-Translations, S.L makes available to Users.

3.3 Links to the Portal 

Any Internet user who wishes to establish links from their own web pages to the Portal must comply with the conditions detailed below, and ignorance of these conditions shall not exempt them from the responsibilities arising under the Law:

  • The link may only connect to the home page or main page of the Portal and may not reproduce it in any way (online links, copying of texts, graphics, etc.).
  • It is strictly prohibited, in accordance with applicable legislation in force at any given time, to establish frames of any kind that surround the Portal or allow the visualisation of the Contents through Internet addresses other than those of the Portal, and in any case, when they are displayed together with external contents in such a way that: (1) Causes, or may cause, error, confusion, or deception among users regarding the true origin of the service or Contents; (2) Constitutes an act of unfair comparison or imitation; (3) Serves to take advantage of the reputation and prestige of the Comunica.DK-Translations, S.L brand; or (4) Is otherwise prohibited by current legislation.
  • No false, inaccurate, or incorrect statements shall be made from the page introducing the link regarding Comunica.DK-Translations, S.L, its partners, employees, clients, or the quality of the services it provides.
  • In no case shall it be stated on the page where the link is located that Comunica.DK-Translations, S.L has given its consent to the insertion of the link, or that it otherwise sponsors, collaborates with, verifies, or supervises the services of the sender.

4. Disclaimer of Liability 

4.1 Information 

Comunica.DK-Translations, S.L accepts no responsibility for decisions made on the basis of information provided on the Portal, nor for damages or losses suffered by the User or third parties as a result of actions based solely on the information obtained from the Portal.

4.2 Quality of Service 

Access to the Portal does not imply any obligation on the part of Comunica.DK-Translations, S.L to ensure the absence of viruses, worms or any other harmful computer elements. It is the User’s responsibility, in all cases, to have appropriate tools available for the detection and removal of harmful computer programmes.

Comunica.DK-Translations, S.L accepts no responsibility for damages caused to Users’ or third parties’ computer equipment in connection with the Portal service.

4.3 Service Availability 

Access to the Portal requires services and supplies from third parties, including transport through telecommunications networks whose reliability, quality, continuity, and operation are not the responsibility of Comunica.DK-Translations, S.L. Consequently, the services provided through the Portal may be suspended, cancelled, or rendered inaccessible, either prior to or simultaneously with the provision of the Portal service. Comunica.DK-Translations, S.L accepts no responsibility for damages or losses of any kind suffered by the User as a result of failures or disconnections in telecommunications networks that cause the suspension, cancellation or interruption of the Portal service during or prior to its provision.

4.4 Contents and Services Linked Through the Portal 

The Portal’s access service includes technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In such cases, Comunica.DK-Translations, S.L acts as an intermediary service provider in accordance with Article 17 of Act 34/2002 of 12 July on Information Society Services and Electronic Commerce (LSSI), and will only be responsible for the contents and services provided on Linked Sites to the extent that it has actual knowledge of their illegality and has not disabled the link with due diligence. If the User considers that a Linked Site contains unlawful or inappropriate content, they may notify Comunica.DK-Translations, S.L in accordance with the procedure and effects established in Section 6, without such communication in any case implying an obligation to remove the corresponding link.

Under no circumstances shall the existence of Linked Sites imply the existence of agreements with their owners or operators, nor the recommendation, promotion or identification of Comunica.DK-Translations, S.L with the statements, contents or services provided. Comunica.DK-Translations, S.L does not know the contents and services of the Linked Sites and therefore accepts no responsibility for damages caused by the illegality, quality, outdated nature, unavailability, error or uselessness of the contents and/or services of the Linked Sites, nor for any other damage not directly attributable to Comunica.DK-Translations, S.L.

6. Reporting Unlawful or Inappropriate Activities 

If the User or any other Internet user becomes aware that Linked Sites refer to pages whose contents or services are unlawful, harmful, defamatory, violent or contrary to morality, they may contact Comunica.DK-Translations, S.L and provide the following information:

  • Personal details of the notifier: name, address, telephone number and email address;
  • Description of the facts revealing the unlawful or inappropriate nature of the Linked Site;
  • In the case of rights violations, such as intellectual or industrial property, the personal details of the rights holder if different from the notifier;
  • Proof of entitlement of the rights holder and, where applicable, proof of representation to act on behalf of the rights holder if different from the notifier;
  • An express declaration that the information contained in the claim is accurate.

Receipt by Comunica.DK-Translations, S.L of the communication provided for in this Section shall not, as provided in the LSSI, constitute actual knowledge of the activities and/or contents indicated by the notifier.

7. Notifications 

All notifications and communications made by the parties shall be valid in accordance with the means permitted by law. Those relating to this Portal shall be deemed effective, for all purposes, if carried out through the Portal itself.

8. Modifications 

Comunica.DK-Translations, S.L reserves the right to make any modifications it deems appropriate to its website without prior notice, including changing, deleting or adding both the contents and services provided through it and the manner in which they are presented. Furthermore, these terms and conditions may be changed at any time. Modifications shall take effect from the moment of their publication.

9. Social Networks 

Comunica.DK-Translations, S.L is present on various social networks and platforms. Therefore, when accessing any of these or other networks, the applicable terms of use are those established by each platform, in which Comunica.DK-Translations, S.L does not intervene.

10. Governing Law 

This Legal Notice is governed in all respects by Spanish law. Whenever the applicable law permits waiver of the established jurisdiction, the courts of Málaga are designated to resolve any disputes, with the User expressly waiving any other jurisdiction that may apply.
