Payactiv, Inc. (“Payactiv,” “we,” “us,” or “our”) provides the Payactiv platform, this website, mobile applications, and related services (together, the “Services”). This Privacy Policy (“Privacy Policy”), which is incorporated into and is subject to the Payactiv Terms and Conditions, describes the personal information that we gather from you on the Services, how we use and disclose such personal information, and the steps we take to protect such personal information. By using our Services, you are agreeing to this Privacy Policy and our Terms and Conditions as they exist at the time of your use of the Services.

Policy Scope and Links to Other Services

This Privacy Policy addresses activities on the Services provided by Payactiv. The Services may contain features or links to websites and services provided by third parties and other products and services that may be made available to you through a third-party website (“Third-Party Service”). Any information you provide to a Third-Party Service, is subject to the policies, if any, of their respective operators governing privacy and security, even if accessed through the Services. We have no control over the nature, content, availability, or privacy and security practices of any Third-Party Service or any third-party sites or services which are linked from, or can be accessed through, the Services. This Privacy Policy does not cover the links within the Services that link to such other Third-Party Services. We encourage you to learn about third parties’ privacy and security policies before providing them with information.

The Personal Information We Collect and How We Use It

Payactiv collects personal information about you in order to:

  1. identify you when you use the Services;
  2. customize your experience;
  3. operate, maintain, enhance, and provide the Services; provide services and information that you request; respond to comments and questions; and otherwise provide support to users;
  4. understand and analyze the usage trends and preferences of our users; improve the Services, develop new products, services, features, and functionality; and perform and participate in studies and develop marketing materials; and
  5. contact you for administrative purposes such as customer service; or 
  6. send communications, including updates on promotions and events, relating to products and services offered by us and by third parties.

When you use the Services or a Third-Party Service, we may collect information about you, either directly from you or from the entity that operates the Third-Party Service. Personal information we collect may include:

  • first name;
  • last name;
  • email address;
  • physical address(es);
  • phone number(s);
  • Social Security number;
  • employee identification number;
  • driver’s license number;
  • date of birth; and/or
  • geolocation data.

We collect and use the personal information described above in order to provide you with the Services in a reliable and secure manner. We also collect and use personal information for our legitimate business interests.

We may use identify verification technologies in our Services to confirm your identity and help prevent fraud. This includes collecting a copy of your government-issued identification and a photo you provide, and using biometric analysis to match your photo to your government-issued identification. This feature, supported by a trusted vendor, creates a facial scan of each image and compares your physical characteristics, such as eye color and other facial features, to confirm your identity. The service also examines information shown on your government-issued identification card to assess authenticity, including checking this information against machine-encoded data and data maintained by the authority that issued the identification. We maintain this information to facilitate your enrollment and other features of our Services that require identity verification.

Some features of our Services are integrated with services provided by Plaid. By using the Services, you acknowledge and agree that your data and information will also be treated in accordance with Plaid’s privacy policy, located at https://plaid.com/legal.

By using the Services and if applicable, you also authorize your wireless operator (AT&T, Sprint, T-Mobile, US Cellular, Verizon, or any other branded wireless operator) to use, or to disclose to Payactiv or its service providers your mobile number, name, address, email, network status, customer type, customer role, billing type, mobile device identifiers (IMSI and IMEI) and other subscriber and device status details, if available, where provided in accordance with your mobile operator’s privacy policy for the duration of our business relationship solely to help verify your identity and to protect against or prevent actual or potential fraud or unauthorized use of our services.

Information Automatically Collected Through the Services

As is true of most other online services, our Services collect certain information automatically. The information may include (i) internet protocol (“IP”) addresses, (ii) the region or general location where your computer or device is accessing the internet, (iii) browser type, (iv) operating system, and (v) other usage information about your use of the Services, including a history of the pages you view.

We may use cookies, web beacons, and other online trackers to: (i) personalize our Services, such as remembering information about you so that you will not have to re-enter it during your visit or the next time you visit the Services; (ii) provide customized advertisements, content, and information; (iii) monitor and analyze the effectiveness of the Services and third-party marketing activities; (iv) monitor aggregate site usage metrics such as total number of visitors and pages viewed; and (v) track your entries, submissions, and status in any promotions or other activities on the Services. In addition to cookies we set directly, we may use third-party cookies on our Services as well.

When you use the Services, we may send cookies – small text files containing a string of alphanumeric characters – to your device. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Services. You can set your browser not to accept cookies, to remove cookies, or to notify you when you are sent a cookie. Please review your web browser’s “Help” menu to learn how to modify your cookie settings. Please note that if you delete, or choose not to accept cookies from the Services, you may not be able to utilize the features of the Services to their fullest potential. Payactiv does not process or respond to web browsers’ “do not track” signals or other similar transmissions that indicate a request to disable online tracking of users who visit Payactiv.com or any smartphone or tablet application provided by Payactiv (collectively, “Site”) or who use our Services.

We may also automatically record certain information from your device by using various types of technology, including “clear gifs” or “web beacons.” This automatically collected information may include your IP address or other device address or ID, web browser and/or device type, the web pages or sites that you visit before or after you use the Services, the pages or other content you view or otherwise interact with on the Services, and the dates and times that you visit, access, or use the Services. We also may use these technologies to collect information regarding your interaction with email messages, such as whether you opened, clicked on, or forwarded a message. This information may be gathered from all users and may be connected with other information about you.

We may use certain third-party web analytics services, including Google, Facebook, and Microsoft, to help us understand and analyze how visitors use the Site and to serve ads on our behalf across the Internet.

  • We may use session replay technologies to help us understand and analyze how visitors use our Services, and to improve the Services. The vendors that support these types of analytics may collect the following types of information from users of our websites: device IP address; screen size; device type (unique device identifiers); browser information, geographic location; and preferred language used to display our website.

Certain external parties whose tracking technologies are in use on our Site may participate in the Digital Advertising Alliance (“DAA”) and its AdChoices opt-out program. Aggregated Services Data

In an ongoing effort to better understand and service Payactiv’s customers, at times Payactiv conducts research on its customer demographics, interests and behavior based on the personal information and other information provided to us. This research may be compiled and analyzed on an aggregate basis and Payactiv may share this aggregate data with its affiliates, agents, and business partners. This aggregate information does not identify you personally and is not considered to be personal information.

When and How We Disclose Personal Information to Others

Generally, we may disclose personal information to vendors and third parties if you consent to us doing so, as well as in the following circumstances:

We disclose personal information to vendors, service providers, and third parties that facilitate delivery of the Services. These parties, which may include financial institutions that process disbursements of funds, third-party web hosts or providers that assist us with identity verification, may have access to or process information about you as part of providing those services for us. 

We may disclose information about you to your employer in order to enable us to verify your identify and otherwise provide and/or enhance the Services.

We may disclose information about you if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws, in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies.

We also reserve the right to disclose information about you that we believe, in good faith, is appropriate or necessary to: (i) take precautions against liability; (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity; (iii) investigate and defend ourselves against any third-party claims or allegations; (iv) protect the security or integrity of the Services and any facilities or equipment used to make the Services available; or (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others.

Information about our users may be disclosed and otherwise transferred to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, or in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.

We may make certain aggregated, automatically-collected, or otherwise de-identified information available to third parties for various purposes, including: (i) compliance with various reporting obligations; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the Services.  All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

When we obtain personal information through our mobile applications, we limit the disclosure of this personal information to service providers and other vendors that provide the same level of protection as required by this Privacy Policy. 

A Note About Our Online Chat Features

Our Services may include online chat features to assist with answering questions and providing information about our Services. When you participate in an interactive chat, either with a virtual or live agent, the contents of the chat may be captured and kept as a transcript. By using a chat feature, you understand that our vendors may process the information obtained through the chat feature in order to provide services on our behalf.

Your Choices About Your Personal Information

We offer you choices regarding the collection, use, and sharing of your personal information and we’ll respect the choices you make. Please note that if you decide not to provide us with the personal information that we request, you may not be able to access all of the features of the Services.

Please note that while any changes you make will be reflected in active databases within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.

If you receive marketing email from us, you may unsubscribe at any time by following the instructions contained within the email. You may also opt out from receiving marketing email from us by sending your request to us by email at [email protected] or by writing to us at the address given at the end of this Policy. In your request, please note you are writing to “unsubscribe” in the subject line or body of the email or correspondence.

Please be aware that if you opt out of receiving marketing email from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten (10) business days for us to process your request, and you may continue receiving promotional communications from us during that period. After you opt out from receiving marketing messages from us, you may continue to receive administrative and transactional messages from us regarding the Services.

Security of Your Information

At no cost to you, we maintain physical, technical, and administrative safeguards to protect your personal information. Our servers are located in the United States and to provide you with the Services, we may store, process, and transmit information in the United States. Personal information may also be stored locally on the device you use to access the Services.

Data Retention

We only retain personal information for a limited period of time for as long as we need it to fulfill the purposes for which we have initially collected it, unless otherwise required or authorized by law.

A customer may request deletion of their personal information, but certain information, such as transaction data, must be retained for legal purposes.

Children

Payactiv does not knowingly collect personal information from children under the age of 13. If we become aware that a child under the age of 13 has provided personal information to Payactiv through the Services, we will endeavor to delete that information from our databases in accordance with applicable law.

Payactiv reserves the right to amend the Privacy Policy at any time, for any reason, without notice to you, other than the posting of the amended Privacy Policy on this website. This Privacy Notice for California Residents (“CA Privacy Notice”) supplements the information contained in the Privacy Policy of Payactiv (“Payactiv”, “we,” “us,” or “our”) and applies only to individuals who are California residents (“consumers” or “you”) and whose Personal Information we process under the California Consumer Privacy Act (“CCPA”). Depending on the Services you use, some of the personal information we collect about you may be covered under other privacy laws and subject to the other notices provided above. Any terms defined in the CCPA have the same meaning when used in this Notice.

The disclosures in this CA Privacy Notice that describe how and why we collect, use, and disclose Personal Information also describe how we have collected, used, and disclosed Personal Information in the prior 12 months.

In the event of a conflict between any other policy, statement, or notice and this CA Privacy Notice, this CA Privacy Notice will prevail as to the Personal Information of California consumers.

Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.

Inferences drawn from other Personal Information.

Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Sensitive Personal Information

Personal Information that reveals a consumer’s Social Security number, driver’s license, state identification card, or passport number;

Personal Information that reveals a consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account;

Personal Information that reveals a consumer’s precise geolocation; and

Personal Information that reveals the contents of a consumer’s mail, email, and text messages unless the business is the intended recipient of the communication.

We also collect some Personal Information that does not directly fit within one of the categories defined by the CCPA. For example, we collect the contents of communications and information you send to us and authorize on the Site, such as criminal backgrounds and drug screenings for job applicants and employee IDs for users. Unless otherwise specified, the sources of this Personal Information, the purposes for which we use it, and the categories of persons to which we disclose it are the same as those listed for Identifiers.

We do not use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA.

Selling and Sharing of Personal Information

We do not sell Personal Information for money. However, we disclose Personal Information to third parties via cookies and other online tracking technologies on our website for cross-context behavioral advertising and other advertising, marketing, or analytics purposes. Under the CCPA, these kinds of technologies may be considered a “sale” or “sharing” of Personal Information. Under the CCPA, we sell or share for cross-context behavioral advertising the following categories of Personal Information to advertisers and marketing partners, data analytics providers, and social media networks for advertising purposes via website cookies and tracking technologies:

We do not knowingly sell or share for cross-context behavioral advertising the Personal Information of consumers under 16 years of age.

You have the right to direct us not to sell your Personal Information or share your Personal Information for cross-context behavioral advertising. You can opt out of sales and sharing by clicking the “Your Privacy Choices” link in the footer of our website and selecting ”Reject Optional Cookies” or by using the global privacy control (“GPC”) signal. Only you or your authorized agent registered can submit a request relating to your Personal Information. Whether you submit your request directly or through an authorized agent, you must provide us with information that is sufficient to allow us to reasonably verify your identity. In most cases, this means that you will be asked to provide 2-3 pieces of Personal Information that we will match against our records to verify your identity.

Non-Discrimination

We will not discriminate against you for exercising any of your rights under the CCPA.
