𝐆𝐃𝐏𝐑 𝐚𝐧𝐝 𝐀𝐈 𝐀𝐜𝐭 – 𝐌𝐚𝐩𝐩𝐢𝐧𝐠- 📚 Yesterday, the AI Act entered into force 🌟 It is well known that there are numerous intersections between the GDPR and the AI Act. As recently emphasized by the EDPB, these two frameworks should be interpreted as complementary and mutually reinforcing. To facilitate analysis, I have prepared an overview of GDPR references found in the AI Act, with a mapping table included in this post. The table includes links to the respective provisions for easy navigation. In summary: 📊 The GDPR is mentioned 30 times in the AI Act: 13 times in Recitals, 16 times in Articles and Annexes, and once in a footnote. ✅ The GDPR is most often considered in the context of special categories of personal data, biometric categorization, profiling and automated decision-making (ADM), and Data Protection Impact Assessment (DPIA) obligations. A few notable points: ➡️ Where providers of high-risk AI systems process special categories of personal data for the purpose of bias detection and correction, the reasons for such processing and proportionality justification should be included in GDPR Article 30 records. ➡️ When conducting a DPIA, deployers of high-risk AI systems should use the information provided in the ‘instructions for use’ by the providers. A summary of the DPIA should be provided upon the registration of a high-risk AI system. ➡️ Fundamental rights impact assessments should complement DPIAs. ➡️ AI sandboxes should include monitoring mechanisms to identify high risks to the rights of individuals, as defined in GDPR Article 35. ➡️The AI declaration of conformity should include a statement that the AI system complies with the GDPR. Lastly, the AI Act mentions personal data more often than the GDPR, but this mapping is not included in the table. Hope it will be useful, especially for those preparing for the AIGP 🌟

Canada's CAD $100K per violation might not move the needle for large enterprises. Brazil's 2% revenue cap (R$850M maximum) and EU's 4% global revenue create board-level attention. India's ₹250 crore penalty will reshape South Asian data practices once enforcement begins. The strategic insight? PIAs aren't just compliance exercises—they're risk intelligence tools that reveal how different regulators think about data protection. Organizations conducting generic "one-size-fits-all" assessments miss critical jurisdiction-specific requirements.
