    🇪🇺🇺🇸EU-US data transfers are safe for now! ‼️The long-awaited judgment of the General Court in Latombe v Commission (Case T-553/23) has confirmed the validity of the European Commission’s adequacy decision of 10 July 2023, which created the new EU-US Data Privacy Framework. This ruling provides a much-needed moment of stability after the turbulence of Schrems I and Schrems II, when the Court of Justice struck down the two previous transatlantic frameworks. The case was brought by French MEP Philippe Latombe, who argued that the new framework failed to resolve fundamental issues. He claimed that the newly created Data Protection Review Court (DPRC) is neither impartial nor independent, and that U.S. intelligence agencies still conduct bulk surveillance without sufficient safeguards or prior authorisation. The General Court rejected these arguments. It found that the DPRC enjoys sufficient guarantees of independence, since judges are appointed under clear rules, cannot be dismissed arbitrarily, and are protected from interference by the Attorney General or intelligence agencies. The Court also underlined that EU law does not require prior authorisation for bulk data collection. What matters is whether there is meaningful oversight. In this respect, the Court noted that U.S. signals intelligence activities are subject to ex post judicial review by the DPRC, which meets the standard required by EU law. Another important element is the Commission’s continuing obligation to monitor developments in U.S. law. If future changes weaken the safeguards underpinning the adequacy decision, the Commission has the power to suspend, amend, or repeal the decision. This ongoing oversight was seen as a crucial safeguard to ensure that the level of protection remains “essentially equivalent” to that guaranteed within the EU. 💡The case may be appealed to the Court of Justice, and further challenges by privacy activists are already in preparation.For now, however, the General Court’s ruling confirms that the EU-US Data Privacy Framework stands on firm legal ground. This provides welcome breathing space for companies engaged in transatlantic data flows, while reminding us that the balance between privacy rights and national security will continue to be tested in Luxembourg and beyond. #gdpr #rodo

    📌 Data Transfers: GDPR vs. U.S. law: Why Moving Data Across the Atlantic Still Feels Like Walking a Tightrope. You’ve collected personal data in Europe. Now your vendor, cloud service, or analytics tool is in the U.S. Can you just send it over? Here’s why transatlantic data transfers remain one of the most complex - and controversial - issues in global privacy law 👇 🇪🇺 GDPR: Transfers Must Be Justified and Protected Under the GDPR, sending data outside the EU is a restricted act - and only allowed when certain safeguards are in place. ✅ You need an approved mechanism: – Standard Contractual Clauses (SCCs) – Data Privacy Framework (DPF) – Binding Corporate Rules (BCRs), etc. ✅ You must do a Transfer Impact Assessment (TIA) → Especially if using SCCs, to assess whether the destination country (e.g. U.S.) provides equivalent protection ✅ You must monitor and revisit the safeguards over time 🧪 Example: An Irish SaaS company uses a U.S.-based cloud provider. → It signs SCCs, conducts a TIA, and applies extra encryption + access controls - all documented in case of regulatory scrutiny. 💡 Bottom Line: Data transfers from the EU require legal safeguards and documented risk assessments. 🇺🇸 U.S: No General Data Export Law — But the CCPA Adds Pressure The U.S. doesn’t have a GDPR-style restriction on sending data abroad. But California’s CCPA and other state laws are starting to inch closer to cross-border accountability. 📋 Under CCPA, if a transfer counts as a “sale” or “sharing”, you must: – Provide notice – Allow opt-outs – Ensure contractual restrictions on the recipient 🛑 No Transfer Impact Assessment requirement 🛡️ Security and purpose limitation clauses are critical 🧪 Example: A California-based retailer uses a processor in India to handle customer support. → The contract must restrict use to the business purpose and prohibit secondary use. → If not, it could be treated as a “share” under CCPA - triggering opt-out rights. 💡 Bottom Line: CCPA law doesn’t block transfers, but it’s building up consumer control and contractual responsibility around them. 🎯 The Core Difference GDPR → “You can’t send data unless safeguards are in place - and you’ve assessed the risk.” CCPA → “You can send it - but watch what you promise, how it’s used, and whether the consumer can say no.” 🌍 What This Says About Privacy Culture 🇪🇺 “We protect personal data even after it leaves Europe.” 🇺🇸 “We focus on control and transparency - wherever the data goes.” Same cloud.     The Global Privacy Paradox: Why PIAs Mean Different Things Across Borders 🌍 Take a close look at this comparison chart. Five major frameworks—GDPR, CCPA, PIPEDA, LGPD, and DPDPA—all require some form of Privacy Impact Assessment. Yet the similarities end there. Here's what struck me: Enforcement maturity varies wildly. The EU has been refining GDPR enforcement since 2018, with €20M fines creating real deterrence. Meanwhile, India's DPDPA framework is still "developing"—rules pending, enforcement untested. Operating across these jurisdictions means navigating radically different risk profiles. "Mandatory" doesn't mean the same thing everywhere. GDPR's Article 35 creates clear legal obligation. CCPA applies only to "certain businesses" meeting revenue thresholds. PIPEDA? Technically "recommended" but practically expected if you want to avoid OPC scrutiny. Understanding these nuances prevents costly miscalculations. The triggers reveal different priorities. GDPR focuses on systematic monitoring and large-scale profiling. LGPD emphasizes processing sensitive data and cross-border flows.     An important day for transatlantic dataflows, as the General Court of the EU hears the parties in an action concerning the EU-US Data Privacy Framework. In July 2023, based on the EU-US Data Privacy Framework, the European Commission adopted a decision concluding that transfers of personal data from the EU to organisations in the US adhering to the Data Privacy Framework Principles, are subject to an adequate level of data protection. The decision of the European Commission followed a previous adequacy decision, based on the EU-US Privacy Shield, which the EU Court of Justice declared invalid in July 2020 in a case instigated by the well-known privacy activist Max Schrems (C-311/18). Of particular importance for the new Data Privacy Framework is a presidential Executive Order (14086) adopted in October 2022. This Executive Order imposes requirements of necessity and proportionality on the US intelligence community and led to the creation, by the US Attorney General, of a new redress mechanism: the Data Protection Review Court. The French parliamentarian Philippe Latombe filed an action for annulment of the Data Privacy Framework decision with the General Court, arguing, amongst others, the lack of independence of the new Court.
