As the panel unpacked real-world audits and case studies, I discovered a set of hidden GDPR articles that quietly sync with the way modern AI actually works. That’s when it hit me → the toughest GDPR tests for AI often come from five quieter articles that regulators rely on to measure real compliance. Here are the five that every AI user should have on their risk radar: 💡 GDPR guards the data. The EU AI Act governs the AI system itself. Most teams forget you need to pass both tests. Rule 1 → Article 22: Automated Decision-Making & Profiling Yes, this is the human-in-the-loop safeguard. If your model makes a decision solely by algorithm with legal or significant impact (credit, hiring, healthcare, insurance), users have the right to: ↳ Opt out of the automated decision ↳ Demand a human review before the outcome stands ➡️ Designing that review pathway isn’t optional; it’s architecture. Everyone is talking about the #AI Act but very few appreciate how complex it is, blending product safety approaches with the protection of fundamental rights, and establishing a risk-based approach far more granular than the #GDPR. Here are 5 steps to prepare for it: 1️⃣Do an #AI mapping exercise – First of all, determine and document in a central AI inventory which AI systems and models are being developed and used. Include the nature of the technology, intended purposes, types of outputs generated, data processed & third party vendors. 2️⃣Carry out an AI Act applicability assessment – Taking into account the #AI inventory, determine whether the Act will apply to your development & use of AI, and if so, the extent of that application to each particular AI system & role. 3️⃣Establish an #AI governance committee – Given the multi-faceted nature of the AI Act, it is also essential to assemble a suitable multi-disciplinary team covering different aspects of the business to ensure that all responsibilities under the law are properly addressed. 4️⃣Identify existing compliance mechanisms – With the involvement and help of the #AI governance committee, identify any existing AI governance compliance practices & documentation. This will include policies & protocols followed by the product development team & #privacy team. 5️⃣Undertake an AI Act gap analysis – Once all the necessary #AI governance compliance information has been gathered, review it against the applicable requirements previously identified to devise a compliance plan with the necessary documentation & measures in order of priority.

Europe just made AI governance non-negotiable. prEN 18286 (EU AI Act QMS) is out, once cited, it grants presumption of conformity. Reality check: ISO/IEC 42001 ≠ EU AI Act compliance. Translation: for high-risk AI providers, you’ll need evidence, not promises, design controls, data governance, risk management, and post-market monitoring that auditors can verify. Do these 5 moves now: - Map every AI system to EU AI Act risk tiers. - Implement controls aligned to the new harmonized standards. - Show your work: tech docs, eval evidence, audit trails. - Challenge vendors—model cards, data lineage, red-team results. - Monitor in production like safety-critical software. Simplifying it , your fast path: risk-map → standardize controls → prove with evidence → vendor due diligence → live monitoring. Simple to say, and hard to fake. Most companies are diving into AI without guardrails—no policies, no employee training, and no clarity on what data is safe to share. It’s a lawsuit waiting to happen. And that’s where you come in. AI Compliance Checklist: What Your Clients Need 1. Internal AI Usage Policies: • Clearly define which AI tools employees can use, distinguishing between Open AI (like ChatGPT) and Closed AI (proprietary models). • Set strict rules for handling client data—no confidential information should be processed by external AI without approval. • Train employees on the risks of AI misuse, data privacy, and responsible usage. 2. External Data Protection: • Review and update all vendor contracts to ensure they cannot share your client’s data with Open AI or third-party AI systems. • Require third-party vendors to maintain secure, compliant AI practices, including clear data security standards. • Establish a third-party risk assessment process focused on AI use, and demand indemnification for unauthorized data sharing. 3. AI Insurance Review: • Evaluate Cyber Liability policies to ensure they cover AI-related data breaches and unauthorized disclosures. • Confirm Errors & Omissions (E&O) coverage includes mistakes caused by AI-driven services, like flawed automated advice. • Add Specialized AI Endorsements to cover unique risks (e.g., deepfakes, AI-generated misinformation). • Make sure your firm’s Legal Malpractice policy covers AI-related errors, from misused client data to flawed AI-driven legal advice. But First—Check Your Own Coverage Before you advise clients on AI compliance, make sure your own house is in order. Does your malpractice policy protect you against AI-related mistakes? Are there hidden exclusions for AI misuse? If you’re not covered, you’re exposed. AI is your client’s biggest opportunity—and their biggest risk. Make sure you’re the one they trust to handle both.

Here’s a real-world checklist every enterprise team should review before going live with GenAI tools: - Data Privacy & Sovereignty Ensure PII, PHI, and sensitive business data are handled per GDPR, HIPAA, CCPA, and relevant local regulations. Consider regional model hosting where required. - Model Transparency & Explainability Can you explain why the model made a specific decision or output? Start with a multidisciplinary team; conduct an AI inventory; carry out AI Impact Assessments; draft AI policies; amend contracts, policies, and data protection documents to reflect AI’s role in your organisation. Ensure your team is trained in AI literacy, as required under the AI Act. To navigate AI implementation and compliance under the EU AI Act, companies must begin by understanding its scope and risk-based approach. The Act categorises AI systems into prohibited, high-risk, or general-purpose. Prohibited AI systems (the first rules coming in) include those exploiting vulnerabilities or engaging in certain AI emotional recognition. High-risk systems, such as those used in management of critical infrastructure, require strict oversight, including documentation, risk assessments, and ongoing monitoring. General-purpose AI systems, widely used across industries, may also face regulatory scrutiny due to their broad impact. The first step for companies is conducting a comprehensive AI inventory. This involves cataloguing all AI systems in use or under development to determine their classification under the AI Act. Through this inventory, companies can assess their compliance obligations and identify any systems that may need modification or discontinuation to meet the Act’s standards. Data protection is a cornerstone of AI compliance. The AI Act mandates that data used in AI systems be high quality, representative, and free from bias. This is especially crucial for high-risk systems, which must undergo continuous risk assessments to protect fundamental rights. GDPR compliance is also essential for any AI system that processes personal data, and companies must ensure their data governance strategies focus on transparency, accountability, and safeguarding individual rights. Contracts are a critical component of AI implementation. Organisations must revisit and amend contracts to address how AI impacts their legal and operational frameworks. These amendments should explicitly cover liability for AI-generated decisions, intellectual property ownership of AI-generated outputs, and data protection compliance. Contracts must minimise legal exposure. Additionally, intellectual property issues around AI, such as ownership of outputs or the use of third-party data, should be clearly defined in these agreements. Following the AI inventory, companies must conduct an AI impact assessment. This assessment includes both a Data Protection Impact Assessment (DPIA) and a Fundamental Rights Impact Assessment (FRIA).
