The Oregon Department of Justice released new guidance on legal requirements when using AI. Here are the key privacy considerations, and four steps for companies to stay in-line with Oregon privacy law. ⤵️ The guidance details the AG's views of how uses of personal data in connection with AI or training AI models triggers obligations under the Oregon Consumer Privacy Act, including: 🔸Privacy Notices. Companies must disclose in their privacy notices when personal data is used to train AI systems. 🔸Consent. Updated privacy policies disclosing uses of personal data for AI training cannot justify the use of previously collected personal data for AI training; affirmative consent must be obtained. 🔸Revoking Consent. Where consent is provided to use personal data for AI training, there must be a way to withdraw consent and processing of that personal data must end within 15 days. 🔸Sensitive Data. Explicit consent must be obtained before sensitive personal data is used to develop or train AI systems. 🔸Training Datasets. Developers purchasing or using third-party personal data sets for model training may be personal data controllers, with all the required obligations that data controllers have under the law. 🔸Opt-Out Rights. Consumers have the right to opt-out of AI uses for certain decisions like housing, education, or lending. 🔸Deletion. Consumer #PersonalData deletion rights need to be respected when using AI models. 🔸Assessments. Using personal data in connection with AI models, or processing it in connection with AI models that involve profiling or other activities with heightened risk of harm, trigger data protection assessment requirements. The guidance also highlights a number of scenarios where sales practices using AI or misrepresentations due to AI use can violate the Unlawful Trade Practices Act. Here's a few steps to help stay on top of #privacy requirements under Oregon law and this guidance: 1️⃣ Confirm whether your organization or its vendors train #ArtificialIntelligence solutions on personal data. 2️⃣ Validate your organization's privacy notice discloses AI training practices. 3️⃣ Make sure organizational individual rights processes are scoped for personal data used in AI training. 4️⃣ Set assessment protocols where required to conduct and document data protection assessments that address the requirements under Oregon and other states' laws, and that are maintained in a format that can be provided to regulators.

Instead of clicking through pages, you'll have natural conversations to shop, get support, or find information—like talking to a knowledgeable friend. This transforms online experiences but means sharing far more personal data than ever before. Today's consent flows control how vendors use your click history and search terms. With AI agents, you're sharing emotional state, personal context, and subconscious information through natural language. Consider these conversations: "I need a bridesmaid dress under $200—money's tight and my sister's wedding is next month" "I'm looking for senior care for my dad—he's getting forgetful and I'm worried and don’t want him to be alone" "This is my third support ticket this week and I'm late picking up my daughter from soccer" Each reveals intent (buy dress, find care, solve billing) plus contextual personal data (financial stress, family dynamics, emotional state) far beyond traditional clicks. While detecting intent solves problems quickly, this changes privacy stakes. I don't mind if advertisers know I clicked on dresses to show recommendations. But I don't want them knowing I'm financially stressed from shopping conversations, then excluding me from certain offers. As an industry, we will need new standards and technology to address these issues. Here are three key areas we must solve: ‣Intent & Contextual Personal Data Transparency: When AI detects my intent or personal context, I want visibility to confirm, correct, or delete it. If you're profiling me, show me what makes up that profile. ‣Improved Controls: CMPs based on today's static categories will no longer work. My financial constraints might help find a budget dress but shouldn't feed algorithmic pricing or determine the tier of support I get. We need purpose-specific and intent-specific permissions, plus new standards (e.g. IAB TCF for agents, #A2A, #ACP, #AGNTCY) governing how this richer personal data gets shared. Also, time-based consent—knowing my emotional state for this conversation but forgetting it afterwards increasingly is important. ‣Conversational Consent UX: Upfront consent banners don't work when new intent and personal data emerge during conversation. Consent needs to move inline with agent flows—which is actually a huge UX opportunity. Instead of annoying pop-ups, we can align consent with the actual value exchange in real-time. Sharp HealthCare is facing a class-action lawsuit. The AI scribe they deployed allegedly documented fabricated patient consent. A lawsuit claims San Diego-based Sharp HealthCare used Abridge, an AI dictation tool to record patient conversations without consistent consent since April 2025. That alone would violate California law, which requires all parties to consent before recording sensitive conversations in healthcare settings. But here's where it gets worse. The AI allegedly wrote its own consent confirmations. Jose Saucedo, the primary plaintiff, noticed his medical record appeared AI-generated. When he contacted Sharp, they confirmed using the tool and apologized. But his notes contained statements confirming he was "advised about recordings and consented." He never consented. The AI appears to have added that confirmation itself. What the lawsuit alleges: → Staff marked patients as "consented" without actually asking → Abridge captured everything said in exam rooms (diagnosis, treatment plans, protected health information) → Audio recordings stored by Abridge to improve its AI → Approximately 100,000 patient encounters recorded since rollout This violates HIPAA and California privacy law if the allegations are accurate. Here’s why this matters beyond one health system: AI scribes are being deployed rapidly across healthcare. The productivity benefits are real. But implementation without proper consent infrastructure creates legal and ethical risk. The problem isn't the technology. It's how it was deployed. Consent can't be assumed. It can't be fabricated. And it definitely can't be auto-generated by the AI itself. What proper deployment looks like: Explicit verbal consent before each recording. Not a checkbox in the EHR. Not a sign on the wall. Actual conversation with the patient about what's being recorded, where it's stored, and how it's used. Clear opt-out mechanisms without penalty. Patients who decline shouldn't face delayed care or incomplete documentation. Transparent audit trails showing when consent was obtained and by whom. or AI-generated confirmations that can't be verified. This case will likely force health systems to examine their own AI scribe implementations. Sharp has declined to comment on pending litigation. Day 6 of MCP Security: How Does MCP Handle Data Privacy and Security? In MCPs, AI agents don’t just call APIs — they decide which APIs to call, what data to inject, and how to act across tools. But that introduces new privacy and security risks 👇 𝗪𝗵𝗮𝘁’𝘀 𝗗𝗶𝗳𝗳𝗲𝗿𝗲𝗻𝘁 𝘄𝗶𝘁𝗵 𝗠𝗖𝗣𝘀? In traditional systems, data moves in defined flows: Frontend → API → Backend You know what’s shared, when, and with whom. 𝗜𝗻 𝗠𝗖𝗣𝘀: • Context (PII, tokens, metadata) is injected at runtime • The model decides what’s relevant • The agent can store, reason over, and share user data autonomously • Tool calls are invisible unless explicitly audited 𝗞𝗲𝘆 𝗣𝗿𝗶𝘃𝗮𝗰𝘆 𝗥𝗶𝘀𝗸𝘀 𝘄𝗶𝘁𝗵 𝗠𝗖𝗣𝘀 1. Context Leakage: Memory and prompt history may persist across sessions, allowing PII to leak between users or flows. 2. Excessive Data Exposure: Agents may call APIs or tools with more data than needed, violating the principle of least privilege. 3. Unlogged Data Flows: Tool calls, prompt injections, and chained actions may bypass traditional logging, breaking auditability. 4. Consent Drift: A user consents to one action, but the agent infers and performs other actions based on the user's intent. That’s a privacy violation. 𝗪𝗵𝗮𝘁 𝗣𝗿𝗶𝘃𝗮𝗰𝘆 𝗖𝗼𝗻𝘁𝗿𝗼𝗹𝘀 𝗠𝗖𝗣 𝗦𝘆𝘀𝘁𝗲𝗺𝘀 𝗠𝘂𝘀𝘁 𝗜𝗻𝗰𝗹𝘂𝗱𝗲: ✔️ Context Isolation Prevent data from crossing agent sessions or user boundaries without explicit logic. ✔️ Prompt-Level Redaction Strip sensitive data before it's passed into agent prompts. ✔️ Chain-Aware Access Controls Control not just what tool can be called, but how and when it’s called, especially for downstream flows. ✔️ Logging & Audit Trails for Reasoning Log not just API calls, but: Prompt inputs Tool decisions Context usage Response paths ✔️ Dynamic Consent Models Support user-level prompts that include consent logic, especially when agents make cross-domain decisions. In short: MCPs don’t just call APIs, they decide what data to use and how. If you’re not securing the context, the memory, and the tools, you’re not securing the system.

Here’s how the system quietly works: when you submit an article, paper, or client file, it often passes through AI-assisted workflows — plagiarism detectors, “review-support” bots, grading tools, summarizers, or translation engines. Each stage can copy, store, and process that data in cloud-based servers or third-party models. Your consent is rarely requested, and your data often ends up tagged, logged, and retrievable long after the task is complete. Why it happens: Because efficiency sells. Journals, schools, and hospitals are under pressure to automate. AI tools offer faster review, translation, or scoring — and in most policies, “AI assistance” is lumped under software optimization. That loophole lets them bypass informed consent, especially when human reviewers or staff are “only using the system for support.” How they get away with it: The legal definitions of processing and training are still gray zones. Under GDPR, consent is required for personal data, but not necessarily for ideas, structure, or expression if those are treated as “non-identifiable.” So your intellectual labor — not your name — becomes fair game for algorithmic analysis. AI isn’t stealing your work; policy silence is handing it over. Institutions and corporations feed models “to improve efficiency.” But efficiency has a cost: your authorship, your privacy, and sometimes your competitive edge. Here’s the chain of events they don’t advertise: 1️⃣ You upload. 2️⃣ Systems replicate and index. 3️⃣ Cloud backups persist indefinitely. 4️⃣ Machine learning extracts “patterns.” 5️⃣ Those patterns become product features. Even if you request deletion, the representation of your data — what it taught the system — remains. The ghost of your knowledge lives on in algorithms built without your consent. And if you think you can escape it? You can’t. This isn’t dystopia — it’s daily practice. AI doesn’t need to “steal” your work; policy silence gives it permission. Consent in the AI era isn’t a checkbox — it’s a chain of custody. Even if you move to an isolated island, your digital history — medical records, emails, academic papers, social posts — is already distributed across global servers and mirrored storage. It doesn’t need you to exist anymore. It’s archived, backed up, and mined for insight. The question isn’t whether your work will be uploaded. Healthcare systems are designed around a hard-earned assumption: information can be wrong, incomplete, or misinterpreted, and when it is, there must be a way to see it, challenge it, and correct it. That assumption is not philosophical. It is structural. It is why medicine treats records, authority, and accountability the way it does. AI systems entering healthcare are quietly breaking that assumption. Tools like ChatGPT Health and OpenAI for Healthcare are being positioned as helpful, conversational, and supportive, but beneath that surface they collapse access, interpretation, memory, and influence into a single architectural layer. Once that happens, errors stop being isolated events and start becoming durable narratives. Influence begins to accumulate without visibility. Interpretation persists without consent. Control disappears precisely where medicine has always insisted it must exist. This is not a question of intent, intelligence, or innovation speed. It is a question of system design. As a systems engineer, I do not believe the work ends at identifying risk. The work is designing systems so that risk cannot silently propagate. Medical AI can be built responsibly, but only if control, traceability, and patient authority are treated as first-order architectural requirements, not features to be added later.
