As summer travel ramps up, so does the use of biometric technologies at airports, border crossings, and even hotels and theme parks. From facial recognition to fingerprint and iris scanning, these tools are marketed as time-saving conveniences that promise increased security and a more seamless travel experience. Beneath the surface of this "convenience" lies a pressing question: Who is most vulnerable when biometric data is collected—and who bears the burden when it is misused? For Black, Indigenous, and People of Color (BIPOC) and disabled travelers, the answer is clear: we are disproportionately at risk. Biometric technology is increasingly embedded in travel infrastructure. Most airlines offer facial recognition boarding, and the U.S. Customs and Border Protection (CBP) continues to expand its biometric exit and entry programs. While the stated aim is efficiency and security, the rapid deployment of these technologies often overlooks the civil rights and privacy implications—particularly, and especially for marginalized groups. Facial recognition algorithms are far more likely to misidentify Black, Brown, and Indigenous faces. Clarke, this legislation places hard guardrails around AI and algorithmic systems used in decisions related to hiring, housing, healthcare and beyond. It demands transparency, bias testing, and accountability. Think of it as GDPR for bias, but with broader implications across HR, tech, and operations. “We will not allow AI to stand for Accelerating Injustice.” – Senator Ed Markey for U.S. Senate 2. California’s new workplace AI discrimination laws are now in effect. The new rule governing companies' use of automated decision-making technology will likely create a situation where companies are liable for hiring practices if a system violates anti-discrimination laws. As other U.S. states also implement laws and regulations containing similar ADMT protections, companies deploying the technology will need to be proactive in their record keeping and vetting of third-parties while auditing their own tools to understand how the software functions. Insurers are backing away from covering AI risks AIG, Great American, and WR Berkley are asking regulators to exclude AI-related liabilities from their policies. Why? There’s a chance you might be using biometric categorisation systems in your business and depending on how you use them, that use could be banned from 1 February 2025… The AI Act's treatment of biometric categorisation systems is tricky, particularly when distinguishing between prohibited and high-risk applications. Article 3(40) defines a biometric categorisation system as one that assigns individuals to specific categories based on biometric data, unless it is ancillary to another commercial service and necessary for technical reasons. This distinction is crucial in understanding the broader regulatory landscape. Biometric data, as defined in Article 3(34), includes personal data resulting from processing related to physical, physiological, or behavioural characteristics. Article 3(35) extends this to biometric identification, involving the automated recognition of these characteristics to establish identity. Article 5(g) of the AI Act prohibits the placing on the market, putting into service, or use of biometric categorisation systems that deduce or infer sensitive attributes such as race, political opinions, or sexual orientation. This prohibition is specific and absolute, aiming to prevent systems from making inferences that could lead to discrimination or privacy violations. Recital 30 supports this by highlighting that while categorising data sets lawfully acquired for attributes like hair colour or eye colour may be permissible in certain situations, deducing sensitive personal attributes is strictly prohibited. In contrast, high-risk biometric categorisation systems, as referenced in Article 6(2) and detailed in Annex III, are subject to stringent regulation rather than outright prohibition. These systems, used for purposes like identifying sensitive or protected attributes, are considered high-risk due to the potential for significant harm or influence on decision-making outcomes. Recital 54 underscores the high-risk classification by noting the discriminatory potential and technical inaccuracies that could affect protected characteristics like age, ethnicity, or race. Deployers of high-risk biometric categorisation systems must also adhere to specific transparency obligations under Article 50(3), including informing individuals exposed to these systems and processing data in compliance with GDPR and other relevant EU regulations. This reflects the Act's intent to ensure transparency and safeguard individual rights, even for high-risk systems. The key difference between banned and high risk biometric categorisation seems to lie in the nature and sensitivity of the categorisation. Prohibited systems directly infer highly sensitive attributes from biometric data, while high-risk systems involve categorising biometric data in ways that could indirectly affect individuals’ rights and outcomes. This distinction can lead to confusion, particularly where the line between sensitive inferences and lawful categorisations is blurred.
