The Future of Space Law: The Evolving Dynamics of Air and Space Regulation, Saudi Arabia Center for Space Futures 2025

International space law was written for a world that no longer exists. The treaties that guide us, visionary as they are, were crafted when only two nations had the power to reach orbit. They focused on peace and principles, not procedures or property rights. Today, we face a very different landscape: commercial launch providers, multinational resource ventures, private stations, lunar habitats and AI systems operating with increasing autonomy. Yet the legal framework that governs them still reads like a Cold War time capsule. As I always say, mind the gaps (thank you London Tube!) and inconsistencies. This is precisely why lawyers are needed. But not as regulators or obstacles. Lawyers are the navigators of this new era. We shouldn’t tell industry what it can’t do; we should help it understand how to do what it wants to do — responsibly, sustainably and lawfully. Good space lawyering isn’t about drawing borders. It’s about drawing pathways and aligning innovation with international obligations so that progress doesn’t stall at the edge of legality. The next leap in human civilization won’t be powered by rockets alone. It will be powered by law that keeps pace with technology and imagination alike. Because space doesn’t need more rules. Earlier today I attended Washington Arbitration Week’s panel on “Space Law in the New Space Age: sovereignty, resources, and dispute resolution” — an eye-opening discussion on the legal challenges rapidly emerging as space exploration shifts from government-led missions to private ventures. From space mining to the evolving role of international law and arbitration, the panel tackled the pressing need for clearer frameworks to govern ownership, responsibility, and conflict in outer space. A timely and thought-provoking session on the future of law.

What can the spaces of constitutional history tell us about the challenges of constitutionalism today? This question guided the MPI Network Event ‘Constitutional Places’, held on 1 October at the Max Planck Institute for Legal History and Legal Theory in Frankfurt. The event introduced the newly published book ‘Verfassungsorte / Constitutional Places’, co-authored among others by Russell Miller, former Research Coordinator of Max Planck Law. Blending scholarship and imagery, the book explores more than twenty-five German sites where constitutional ideas have been debated, enacted, and reimagined over five centuries. Discussions traced how architecture and law intersect—how buildings such as Karlsruhe’s Bundesverfassungsgericht or Frankfurt’s Paulskirche embody evolving constitutional values, transparency, and renewal. The event concluded with guided tours of Frankfurt’s constitutional landmarks and a reception fostering continued dialogue on the spaces that shape law and democracy.
