A series of recent developments across jurisdictions points to a difficult reality: the misuse of AI to generate explicit images is no longer hypothetical, it is already testing legal systems worldwide.
📍 Greece
In a secondary school in Heraklion, students reportedly used AI tools to alter photos of classmates and teachers, creating non-consensual explicit images that were circulated among peers. The case is particularly alarming as it involves minors both as subjects and users, raising immediate questions around criminal liability, consent, and digital harm.
📍 United States
At the same time, xAI is facing a federal class action lawsuit alleging that its models enabled the creation of sexualised images of identifiable minors. The claim focuses not only on the outputs, but on alleged failures in safety design, moderation, and foreseeable misuse, placing AI developers directly within the scope of liability discussions.
📍 European Union
Regulators are moving with increasing urgency. Recent legislative developments indicate strong support for a ban on AI-generated child sexual abuse material (lawmaker Michael McNamara stated "A proposal to ban so-called nudification apps I believe is something that our citizens expect of the co-legislators"), and restrictions on applications capable of producing non-consensual explicit imagery.

Different jurisdictions, different legal frameworks - yet the same underlying risk: Consent is bypassed at scale, real individuals are digitally altered without knowledge or control, technology outpaces safeguards.
From a legal standpoint, this raises a set of increasingly urgent questions:
❓Where does platform responsibility begin and end?
❓Can existing frameworks on privacy, data protection, and personality rights adequately capture synthetic harm?
❓And, critically, should certain AI functionalities be prohibited altogether, rather than regulated?
With ongoing judicial and legislative processes examining the matter across jurisdictions, the challenge now is coherence. Because when harm is global, scalable, and deeply personal, fragmented responses may not be enough

Thank you for sharing, as this brings up an interesting discussion over a problem that was not properly vetted before the AI capability cat was “let out” of the bag. I can completely see that the third party app should hold accountability. But piggybacking on the explainability issues in AI, I would contend that there is still culpability on the company providing the capability. Honestly, I still stew on what percentage of culpability is appropriate. Often, analogs help me in cases like this (for example, a medical facility uses a third party for equipment that is defective and irresponsibly designed…while the company is using it, the tool itself functionally could be negligent by not safeguarding what they built). Apologies for distilling a days-long philosophical discussion regarding ethics into a post. Thought provoking, thank you!
