Written agreements provide leverage during contract negotiations. When issues arise repeatedly, referencing prior commitments to payment terms becomes a powerful tool for ensuring future compliance. If I had to pick only one piece of advice to share with you – about how to avoid many disputes – it would be this: “Put it in writing.” So many of the hundreds of cases I’ve mediated involved critical information which – had it been reduced to writing – would have completely averted the dispute. Bottom Line: Whatever information is critical to a full and accurate understanding of the transaction - think like a lawyer and put it in writing.
