Over 100 years ago, a delegate balance was reached between labor and industry, labor being the workers or the employees, industry the employers or businesses. This balance protected the employers from unlimited tort exposure and work accidents and protected the employees by not having to prove fault of an accident to recover their benefits. Restated the employees benefit by not having to prove fault like you would in a car wreck or a slip and fall type injury to get medical and or indemnity benefits. The employers benefit by not having to pay pain and suffering as a result of this work accident. It's a delicate balance. It makes workers comp cool for both employees and employers.
