Last week, we completed our largest transaction to date—the sale of another private healthcare practice. When the IRS gets it wrong, then right.... The SECURE Act of 2019 introduced a 10-year rule of distributions for non-spouse beneficiaries, often adult children of the participant. Original interpretations of the law were that this class of beneficiary had the flexibility to withdraw retirement funds at any time in the 10 year window. However - the IRS initially decided that 10% per year was what the law intended. Yuck! Now we have the definitive answer... 1. When the participant has begun taking RMDs, the beneficiary must take RMDs “at least as rapidly” as the participant had been. In the event there are assets remaining at the end of 10 years, the remaining balance will be forced out. 2. If the initial participant had not taken an RMD, then the beneficiary does not need to take RMDs and can choose to simply withdraw the entire balance at the end of 10 years.
