As IAC was back in Australia this year so, too, was the International Institute of Space Law’s annual symposium on the law of outer space. I was proud to present International Aerospace Law & Policy Group’s research on a novel approach for patent law in space. The paper explores how the legal community can resolve the ambiguities of intellectual property in outer space in a way which streamlines the regulatory process all the while better incentivising development. How to do this? It begins by respecting the distinction between the universality of expressing ideas and the excludability of tangible artefacts. The paper shows how this Expression-Exclusion Divide promotes economic prosperity, individual rights, efficient governance and, not least, the principles under the Outer Space Treaty. 🚀 I had the honor of presenting our joint paper with Dr. Mohamed Amara, “Legal Challenges in Space Arbitration Arising from Increasing Military Involvement”, at the International Astronautical Congress (IAC) 2025 in Sydney! 🌍✨ Our research showed that the growing integration of private space companies into security and defense architectures creates not only challenges for arbitration, but also highlights its role as a factor of resilience for commercial space activities in the context of political tensions. 🔑 Key conclusions: • ⚖️ Arbitration maintains relevance through neutrality, confidentiality, and flexibility, but its authority is undermined when sovereignty claims dominate. • 🛰️ The integration of commercial space assets into military architectures reinforces the likelihood that future arbitral proceedings will involve assessments of dual-use technologies. • 📜 Arbitration in space disputes should be capable of integrating public law considerations (security, sovereignty, humanitarian law) without losing its private law basis. • 🌐 The resilience of the space economy depends not only on technological redundancy but also on legal adaptability: arbitration must reconcile contractual predictability with sovereign issues to remain viable in the era of militarized space.
