Superior Court of California, County of Alameda Judge and #USFLaw adjunct professor Victoria K. recently dismissed an $8.7 million lawsuit after finding that plaintiffs submitted deepfake videos and other AI-altered items as evidence. Judge Kolakowski's ruling made clear: "Use GenAI in court with great caution." The dismissal, she wrote, sends "the appropriately chilling message to litigants appearing before this Court" that there is "zero tolerance" for attempting to pass deepfakes as evidence. Last evening I attended the Cincinnati Bar Association Potter Stewart American Inn of Court Judge's Night—think judicial speed dating. It's always my favorite program of the year, offering a rare opportunity to hear directly from judges on hot topics in advocacy, artificial intelligence, civility, and the evolving practice of law. The table I moderated hosted four sessions with an impressive lineup: two Ohio Supreme Court justices, two U.S. District Court judges, three First District Appellate judges, and three Common Pleas judges. One interesting takeaway: judges are seeing more pro se litigants using AI to draft pleadings—and it's actually helping. These tools are making legal arguments clearer and more accessible, allowing judges to better grasp the issues at stake. The catch? Hallucinations remain a significant problem, underscoring why human judgment and legal expertise are irreplaceable. If you're a litigator, joining an Inn of Court should be non-negotiable. Direct access to judicial thinking is rare and invaluable.
