- In the United States, the regulatory authorities in individual states also wield significant power to enforce privacy requirements. This power is especially important in our current privacy climate, where there is no broad sweeping privacy law at the federal level. Federal privacy laws are narrow in scope and restricted to specific types of information or industries. This leaves an opportunity for state laws to fill in the gaps without running a foul of preemption under the Constitution's supremacy clause. State laws are generally passed through a state level process that resembles the process used at the federal level. Laws begin in state legislative bodies and must pass through both the upper and lower bodies of the state legislature before being sent to the governor for signature or veto.
