- There are several different sources of law in the United States. The ultimate source of law is the United States Constitution. The Constitution is the supreme law of the land, and no law from any other source is enforceable if it is not consistent with the Constitution. Now, you learned in the last video that the judicial branch has the authority to declare laws unconstitutional, which renders them invalid. The Constitution may be changed through the amendment process, but this is a very significant undertaking that requires a 2/3 majority in both houses of Congress, as well as ratification by the legislatures of 3/4 of the states. Legislation is the second source of law. In the last video, you learned about the process required to pass a bill into law that involves both branches of Congress and the President.
