- The last thing your company needs is an age discrimination lawsuit. They are time intensive, financially costly, morale killers and totally avoidable. In this lesson, I'll describe some of the reasons why age discrimination is increasing and what to do to prevent this painful situation from happening in your organization. Age-related discrimination, or treating an applicant or employee over the age of 40 less favorably because of their age, it's on the rise. The number of age-related discrimination charges filed with employers and the government doubled from 1990 to 2017. One reason for this rise is that there are more older workers in the workforce. This increase of older workers is directly related to an increase in the age of retirement.
