Inspired by Kaivalya Apte's podcast on modern databases and Chris Riccomini's excellent Substack articles, I decided to get my hands dirty with the building blocks of modern storage engines — LSM Trees, WALs, MemTables, and storage/compute separation. Dispelling a few myths about EB-2 NIW: 1. An approved NIW does not grant you work authorization. You will still need a nonimmigrant visa to be able to stay and work in the U.S. (such as H-1B). 2. An approved NIW does not put you in a different EB-2 backlog (EB-2 = EB-2). It does, however, grant you additional flexibility in that you will not need to start a new PERM with a new employer should you switch employers so that you will be ready to file your I-485 when your priority date becomes current. 3. EB-2 NIW is not only for researchers. If you were lucky in the H-1B cap lottery and are moving into H-1B visa status, remember that your work authorization is specific to your worksite. If you change your worksite including moving and working from home, you may need your employer to file an H-1B amendment for you PRIOR to moving. So it is not only important to know an H-1B amendment may be needed. It is also important to know it may be needed PRIOR to moving. Or maybe you are already in H-1B status and you have been enjoying WFH in some scenic place but now you are being called back to work from an office. That situation may also require an H-1B amendment. Failure to comply with the nit-pick H-1B rules could end up causing you problems including inability to get an H-1B visa stamp. •••

Having helped process H-1B visas for people over the years, I can say the program has been an important factor in the growth of the U.S. technology sector. The visa enabled firms to bring in highly skilled workers from abroad during periods when there were simply not enough qualified professionals available domestically. In 2010, I started at a recruitment agency focused on telecom supporting companies like AT&T, Verizon, Sprint, and T-Mobile in their bids to rollout new antenna tech. The industry was racing to deploy AT&T/UMTS, VZW/CDMA, and TMO/HSPA+, and soon after, LTE. During the nationwide rollouts of 3G and 4G networks in the 2000s and 2010s, the U.S. faced a shortage of RF engineers in areas such as performance, design, and optimization. According to the Dept. of Labor, the number of electrical and RF engineers being trained at U.S. universities was not keeping pace with demand and by the mid-2000s, fewer than 10,000 students were graduating with advanced degrees in electrical engineering. Many of these gaps were filled by engineers who came to the U.S. through the H-1B, particularly from India and China. Without that talent, the U.S. would likely have faced delays and risked falling behind in global telecom deployment. Not just in Telecom, H-1B visas have been heavily concentrated in technology across many sectors. In 2022, about 70% of all H-1B approvals were for computer and engineering roles, and nearly two-thirds of H-1B holders worked in the technology sector. Another fun fact, over half of U.S. “unicorn” startups (valued at $1B+) had at least one immigrant founder, many of whom first arrived on H-1B visas. In the case of telecom, it enabled the U.S. to keep pace with critical infrastructure rollouts, ensuring leadership in mobile communications. Will the $100k fee slow foreign hiring, or will big tech companies just pay the premium?

With the recent H1B changes and rising costs, it’s becoming increasingly important for recruiters to stay mindful of visa types when running searches for clients. I often reach out to exceptional candidates, only to find their visa status doesn’t align with the client, creating frustration and lost time on both sides. Wouldn’t it make sense for LinkedIn to include an optional field where candidates can indicate their visa type or sponsorship needs (H1B, OPT, Green Card, etc.)? If handled carefully to avoid bias or discrimination, it could make hiring faster, fairer, and more transparent, especially given today’s shifting visa landscape. But it’s a fine balance. Could such transparency risk limiting opportunities for visa holders, or would it simply make hiring more efficient for everyone? For me, it’s about respect and ensuring no one’s time is wasted on roles or clients that can’t support a specific visa. 💡
