In an important ruling, the California Supreme Court clarified that MICRA's one-year statute of limitations does not apply when a claim arises from general negligence rather than a breach of professional duties owed to a patient. In Gutierrez v. Tostado, the Court addressed a case where an ambulance transporting a patient rear-ended another driver. The justices held that this "garden-variety" traffic accident was governed by the two-year statute of limitations for ordinary negligence claims under section 335.1, and not by MICRA's shortened period. This decision narrows MICRA's scope and will directly influence how similar cases are litigated going forward. Arbitration Law Update High Court Clarifies Limits of Judicial Recourse Against Arbitral Awards Under Section 34 of the Arbitration and Conciliation Act The court made a comparative reference to the U.S. case Hohenzheft v Superior Court of Los Angeles County (2024) 318 Cal.Rptr.3d 475, where the court ruled that arbitrators cannot unilaterally extend time limits. California continues to face a growing crisis: over 1.5 million hearings have gone unrecorded since 2023 due to a shortage of certified stenographers. This shortage disproportionately affects low-income and underserved communities, where litigants often can’t appeal life-changing decisions simply because there’s no official transcript. While some can afford to employ a private court reporter, access to justice shouldn’t depend on one’s ability to pay. Assembly Bill 1189, introduced by Assemblyman Tom Lackey, aims to modernize and expand the court reporter pool by authorizing the certification of digital court reporters and legal transcriptionists. As Lackey notes, “This bill protects due process and protects the record.” AB 1189 would provide for the: - Certification of digital court reporters to capture the official record and swear in witnesses - Certification of legal transcriptionists to produce court-accepted transcripts - Expansion of options—not replacement of stenographers—to ensure full coverage and fair access While AB 1189 addresses California’s immediate need, this is a national issue.
