    Beyond the Red Carpet: Fashion and IP The Met Gala may no longer be at the top of the headlines, but it left behind a bigger question: how do you protect creativity in an industry built on visibility? Fashion sits at the intersection of art, commerce, and legal protection — and the tension between those forces is growing. Take Schiaparelli's couture designs. Known for surrealist detailing and highly distinctive silhouettes, these pieces aren't just "outfits". They're carefully built assets where brand identity, design rights, craftsmanship, and trademark protection all converge. And yet, here's the paradox: the fashion industry, which is built on original designs, still has some of the weakest IP protections. Designs are showcased instantly, shared globally, and replicated just as quickly. That speed, combined with the rise of digital fashion and AI-generated design, is putting real pressure on traditional IP frameworks and designers.
