Also mirrored in article 23, Charter of Fundamental Rights of the EU : The principle of equality shall not prevent the maintenance or adoption of measures providing for specific advantages in favour of the under-represented sex. Commented Oct 24, 2016 at 22:38
  • I have read the directive you have linked in your last line: article 5 speaks about "persons with disabilities" only, and article 7 about "compensat[ing] for disadvantages linked to any of the grounds referred to in Article 1", which includes sexual orientation but not gender. So, if I am reading it correctly, that directive does not apply to positive action in favor of one gender. Commented Dec 15, 2017 at 21:18
  • @FedericoPoloni That's true, my point was that positive action and the general architecture of the Equality Act are in line with the relevant directive. It's true that the directive doesn't apply to gender but that also means it's not a protected characteristic at all under this directive so I see no incompatibility between the two. Maybe that's what you meant by doesn't apply? Commented Jan 12, 2020 at 20:46
  • I think that's what I meant, but this comment was from 2 years ago and my memory isn't that good. :) Commented Jan 12, 2020 at 20:55
  • I remember an airline advertising a job for "Stewardess. Male or female. Dress code: Blouse and skirt". Today they would get applications from men :-) Commented Jul 30, 2023 at 23:20
