I have read the directive you have linked in your last line: article 5 speaks about "persons with disabilities" only, and article 7 about "compensat[ing] for disadvantages linked to any of the grounds referred to in Article 1", which includes sexual orientation but not gender. @FedericoPoloni That's true, my point was that positive action and the general architecture of the Equality Act are in line with the relevant directive. It's true that the directive doesn't apply to gender but that also means it's not a protected characteristic at all under this directive so I see no incompatibility between the two.
