  • Major Legal Development in Accountability & Governance! The Kerala High Court has upheld the 2024 amendment to the Kerala Lok Ayukta Act, reinforcing its constitutional validity and strengthening the role of anti-corruption mechanisms in the state. A Division Bench led by Chief Justice Soumen Sen and Justice Syam Kumar V.M. clarified a crucial point under Section 12: "If the competent authority fails to act within 90 days, it will be treated as 'deemed acceptance' of the Lokayukta’s recommendation." The Court also addressed challenges to the amendment of Section 14, where it was argued that the provision interferes with the powers of the Lokayukta. However, the Court rejected this argument and upheld the amendment. One of the petitions was filed by Ramesh Chennithala, along with others, questioning the constitutional validity of the amendments. Why this matters? This judgment ensures that Lokayukta recommendations cannot be ignored or indefinitely delayed, thereby promoting transparency and accountability.   • "Finality is the backbone of arbitration ⚖️ Once a foreign arbitral award has been upheld by the seat court, it cannot be repeatedly challenged in another jurisdiction under the guise of ‘public policy.’ Re-examining the merits or reopening factual issues at the enforcement stage defeats the very purpose of arbitration.   • SKD V STATE OF UP (2026) Exaggerating Husband's income isn't Perjury! Justice Raj Beer Singh ruled that exaggeration of a husband’s income by his wife in maintenance proceedings does not warrant any action against the wife for perjury . In this case, the Husband filed an appeal at Allahabad High Court against the wife for perjury as she claimed the Husband's income was ₹80,000 when in fact it was only ₹11,000 in order to claim maintenance .   • 🔴 Landmark Ruling | Supreme Court of India | Arbitration Law India just sent a message to the world: we honour our commitments. and we won’t let losing parties use our courts as an escape hatch. Here’s what happened. A group of institutional investors pumped serious capital into a company run by the Mylandlas, with one condition — deliver a qualified IPO by March 2016. The IPO never came. The exit clause triggered. The investors waited. Sent notices. Got nothing. So they went to SIAC, and walked out with a ₹1,400 crore award against the promoters. The promoters challenged it in Singapore. Lost. Then came to India and tried again. The Supreme Court didn’t just dismiss the appeal — it imposed ₹25 lakh in costs to each of the four investor groups. That’s how strongly it felt about the attempt. The ruling rests on two pillars. First, Section 48 of the Arbitration & Conciliation Act, 1996 — which mirrors Article V of the New York Convention — limits the grounds on which a foreign award can be resisted in India to very specific exceptions: incapacity, improper notice, jurisdictional overreach, or public policy. Merits are simply not on that list. Second, the Court applied the doctrine of transnational issue estoppel — once a foreign seat court has decided an issue, Indian courts won’t reopen it. What Singapore settled, stays settled. For investors and businesses operating across borders, this is the clarity they’ve been asking for. India means business when it signs international treaties. But it’s also worth asking — the public policy exception exists for a reason. When Indian promoters, Indian companies, and Indian assets are on the line, should Indian courts be this deferential to a foreign tribunal? It’s a conversation the legal community needs to keep having. One thing is certain though — if you’re signing a shareholders’ agreement with a foreign arbitration clause, understand what you’re agreeing to. That clause isn’t just paperwork.
