Exit polls are now a regular part of India’s election cycle, but there was a time when their publication during voting phases became a serious democratic concern. In 2009, Parliament introduced Section 126A to the Representation of the People Act, 1951, placing restrictions on the publication of exit polls during ongoing elections. The idea was simple yet significant in a multi-phase election system, early trends and projections could influence voter behaviour in later phases. This legal framework gave statutory backing to concerns that had already been raised by the Election Commission and debated in courts, especially around the balance between free speech, media influence, and fair elections. As Indian elections became larger, more competitive, and increasingly media-driven, regulating the flow of electoral information became an important part of protecting the integrity of the democratic process.
