  • The Calcutta High Court recently acquitted a college professor who was found guilty by the trial court and sentenced to 20 years imprisonment for the alleged rape of a 16-year-old girl. A Division Bench of Justice Arijit Banerjee and Justice Apurba Sinha Ray found that the professor was framed in the case under Protection of Children from Sexual Offences Act (POCSO Act) on the basis of the testimony given by his estranged wife Rita Soren and their son. The Court ruled the accused had endured four years of wrongful incarceration on account of police incompetence and antagonistic conduct of a prosecutor. The Court also ordered the Director General of Police to immediately consider initiating disciplinary proceedings against Sub Inspector (SI) Nibedita Koley for allowing herself to be swayed by biased and unreliable witnesses against the man, Pratap Digal. The court also said that Special Public Prosecutor Joydeep Mukherjee should have withdrawn himself from the case but instead used his client and her son’s testimony to frame the appellant who was a professor in Serampore College and was in custody for more than 4 years. Calling it a case of professional misconduct, the Court directed the Chairman of Bar Council of West Bengal to immediately consider initiating disciplinary proceedings against advocate Mukherjee. While directing payment of compensation of ₹10 lakh to Digal, the Court said that the State can recover the same from SI Koley and advocate Mukherjee. • In Twisha Sharma's death case, her mother-in-law and husband have been arrested and sent to 5 days CBI custody as Twisha's family claimed that they had subjected her to torture and harassment. However, we donot see such prompt actions from authorities when such incidents occur with men. A woman who fatally stabbed her husband during a sudden quarrel was spared jail by the Telangana High Court. The court upheld her conviction for culpable homicide but reduced her sentence from four years in prison to only a ₹500 fine. According to the case, the husband had allegedly come to her parents' house, abused her and her family, and a heated argument broke out. In the heat of the moment, she stabbed him with a knife, causing his death. According to a neighbour, his last words before dying were "Amma." The post-mortem report revealed a deep stab wound to the neck that extended into the muscles, blood vessels, clavicle, ribs, and lung, causing fatal internal injuries. The trial court sentenced her to four years of rigorous imprisonment along with a fine of ₹500. The woman paid the fine but moved high court regarding the 4 years of imprisonment. The High Court ruled that the act was not premeditated and fell under Exception 4 of Section 300 of the IPC, which applies when a death occurs during a sudden fight, without prior planning, in the heat of passion, and without undue cruelty. Considering these circumstances, the court took a lenient view and removed the prison sentence, retaining only the fine. SHARE TO SPREAD AWARENESS #formenidia

  • The court made these observations while deciding a matrimonial case from Punjab. The woman had appealed against the February 2026 judgment of a family court in Gurdaspur that allowed dissolution of the marriage between the parties. The marriage took place in November 2021. No child was born from the wedlock. The husband, serving in the Indian Navy, accused his wife of maintaining a relationship with another man even after marriage. He alleged that the wife was “quarrelsome and short-tempered”, frequently returned home late, refused to share a bed with him and remained occupied on her mobile phone for long hours speaking to strangers. He had further alleged that when enquired, he came to know that she is in a relationship with a man much prior to their marriage. She also apologised to her husband and promised not to make any call to respondent No.2 (alleged bf) and also requested him not to disclose these facts to her family members. On 11.01.2023 the wife was found in the house of respondent No.2 and he immediately called her father and brother at the spot and found & dissolved the marriage on grounds of cruelty by wife. Taking note of the same the high court ruled that the family court has “rightly dissolved the marriage between the parties on the grounds of cruelty on part of wife,” but DID NOT APPROVE Of ADULTERY allegations & held that a single meeting between a married woman and her former partner cannot by itself be treated as proof of adultery WHAT DO YOU HAVE TO SAY ABOUT THIS? #formenidia
