Digital Sovereignty = National Security? This week at INSS Israel, we convened a first discussion on digital sovereignty as a potential pillar of national security - shifting the focus from technology itself to state freedom of action, resilience, and tech leadership in the digital age. ➡️ The discussion was structured around three roundtables, examining core components of digital sovereignty: #energy and #infrastructure,#supplychains, and enabling #regulation. These roundtables were designed to surface tensions, trade-offs, and open questions - laying the groundwork for deeper policy work ahead. In accordance with Chatham House rules, I’m not sharing photos or quotes from the discussion, but insights and policy recommendations will follow as the work continues. 💡 One early takeaway was clear: Digital sovereignty is not about isolation - it is about resilience. Diversification, partnerships, and access to data and hardware are critical under growing geopolitical risks. Digital sovereignty depends on the state’s ability to ensure reliable energy, resilient supply chains, and enabling regulation that supports the deployment and operation of data centers as the backbone of cloud, AI, and compute capabilities. Ultimately, it is about choosing where control matters most - and building a strategy that sustains national freedom of action in the digital age. 🙏 Grateful to all participants and partners, from the public and private sectors, for a substantive and forward-looking discussion, and for their openness to engage in a first, exploratory dialogue. Perfect timing for setting up shop stateside. 💼 Simplified Tax Environment (at least tili he potus changes his mind)- Streamlined tax structures and business incentives make US market entry more attractive for Israeli startups and scale-ups in the defense and cyber sectors. The bottom line: This legislation doesn't just strengthen US defense capabilities—it creates a more favorable enviroment for the deep US-Israel defense technology partnership that has driven innovation for decades. Israeli companies with cutting-edge solutions in missile defense, cybersecurity, autonomous systems, and military AI should be evaluating their US expansion strategies now. The Tel Aviv District Court has ruled: under current Israeli patent law, an “inventor” must be a natural person — not an AI system. This decision aligns with prevailing case law worldwide, but its significance goes beyond international consistency and lies in its practical implications for companies and startups operating in AI-driven R&D environments. AI-assisted inventions are not disqualified per se. However, applicants must demonstrate meaningful human contribution, supported by proper documentation, responsibility, and declarations. In an era where AI is embedded in nearly every stage of innovation, the ruling clarifies how patent development and filing processes should be managed — from the very outset. It's complicated.  It's important.  It's doable. Those are the 9 words I left the Israeli audience with at the TopNet webinar "Welcome to America" about what to know when you want to launch business activity in the US from a privacy and AI perspective. In my 15 minutes I tried to bust 5 myths about US privacy and AI enforcement: Myth 1: I'm under the radar 🟣No you are not: the FTC and State regulators have enforced against companies with no boots on the ground (see Avast: https://lnkd.in/e6fPa3nf) and even if they are very small.  🟣If you are, your competitors can and do change this by telling on you to regulators.  🟣The fact that you don't have fancy technology won't save you. There have been thousands of recent privacy lawsuits in the US for issues related to website cookies.    Myth 2: I can deal with it later  🟣Later may be too late for your customers who are starting to ask about privacy at the diligence stage 🟣Later may delay your investment deal. Privacy taking center stage in diligence there too 🟣Sometimes too late is too late and the defect is not curable (DoorDash enforcement https://lnkd.in/g4QEsNUZ) 3. The US doesn't have a Federal privacy law and the Trump Admin doesn't care 🟣FTC still enforcing, a lot  🟣Sectoral laws like HIPAA still enforced.  🟣50 states have consumer protection laws being enforced for privacy violations  🟣20 states have privacy laws, issuing $3 billion in fines in the past year alone 🟣Thousands of lawsuits on website compliance. 4. I did GDPR so I'm fine 🟣US laws are different, and GDPR doesn't cover you for everything you need.  🟣US AI enforcement is stricter and more immediate than EU AI Act. 5. If it's that hard - why bother?  🟣When you engage early you can avoid the issues or mitigate them. It was a pleasure speaking about this, listening to Yossi Ben-Dror, Shahar Strauss and our own Scott Snyder speaking about corporate and tax aspects (so glad I do privacy...)

This week, Shibolet Partner, Shir Sela Pinhas, ECA 🎗 participated in Code for Resilience Hackathon - an inspiring tech initiative dedicated to developing digital solutions that strengthen Israel’s civil, community, and technological resilience in times of crisis. The hackathon brought together developers, product managers, and designers from across the country to create practical tools addressing urgent challenges, such as: Combating anti-Semitic content online, raising awareness for hostages through VR, supporting the IDF reserves system and strengthening mental health resilience. Out of dozens of impressive teams, three were selected as winners, and we’re proud to continue supporting them with legal guidance as they further develop their solutions.
